Notice is hereby given that the City of Sanford, Florida will hold a Charter Referendum Election throughout the City of Sanford on August 28, 2018, in accordance with Ordinance No. 4453, as follows:

 

Ordinance No. 2018-4453

 

An ordinance of the City of Sanford, Florida calling for a referendum election to be held on August 28, 2018 for the purpose of proposing to the electorate of the City of Sanford several revisions to the Charter of the City of Sanford relating to City Commission districts and redistricting.(Section 2.01, Section 6.01 and Section 6.07), elections (Article VI, Section 6.01, Section 6.02, Section 6.03, Section 6.05 and Section 6.06), date of taking office (Section 2.01 and Section 6.04), compensation and expenses (Section 2.02) and the City Clerk (Section 2.08) as well as a transition; providing for ballot language; providing for the duties of the City Clerk; providing for the expression of appreciation for the work of the Charter Review Committee; providing for inclusion in the Charter of the City of Sanford and powers and authority for the code codifier; providing for severability and providing for effective date of ordinance and effective date of proposed Charter amendments.

 

Whereas, controlling State law and the Charter of the City of Sanford, Florida provide for alternative means whereby the City Charter may be amended; and

 

Whereas, the City Commission of the City of Sanford adopted Resolution Number 2017-2681 and created the Charter Review Committee to formulate recommendations for potential proposed amendments to certain provisions of the Charter of the City of Sanford, Florida; and

 

Whereas, the City Commission of the City of Sanford appointed members to the Charter Review Committee and assigned the Committee various provisions of the Charter of the City of Sanford, Florida to review and evaluate and make recommendations relating to as needed; and

 

Whereas, the City Commission adopted Resolution Number 2017-2695, revising the timeline for the Charter Review Committee to undertake its review of the Charter of the City of Sanford, Florida; and

 

Whereas, the Charter Review Committee has met in accordance with the direction of the City Commission, developed, and hereby recommends, that the following proposed amendments to the Charter of the City of Sanford, Florida be submitted to the electors of the City of Sanford at a referendum election held pursuant to the Charter of the City of Sanford, Florida and applicable State law; and

 

Whereas, the Charter Review Committee also expressed its views as to other matters involving City government; and

 

Whereas, the City Commission of the City of Sanford has concluded that it is in the best interests of the citizens of the City of Sanford for the City Commission to propose amendments to the Charter of the City of Sanford at a referendum election in accordance the Charter of the City of Sanford and Section 166.031, Florida Statutes, and in the form set forth herein; and

 

Whereas, words with underlined type shall constitute additions to the original text and strike through shall constitute deletions to the original text.

 

Now, Therefore, be it Enacted By the People of the City of Sanford, Florida, as follows:

 

Section 1. Proposed Revision Of Section 2.01, Section 6.01 and Section 6.07 City Charter; Redistricting.  Section 2.01, Section 6.01 and Section 6.07 of the Charter of the City of Sanford, Florida, are proposed to be amended to read as follows:

 

Section 2.01. - Composition, terms, and eligibility.

(a) City Commission. The local governing body of the City shall be That there is hereby created a City Commission of the City of Sanford, Florida to consist of five (5) members; four (4) commissioners and consisting of a Mayor, who shall also be known as a Commissioner, and either four (4) or six (6) City Commissioners in number, as determined by ordinance enacted by the City Commission, all each of whom shall be elected for a term of four (4) years both commencing and terminating on the fourth Monday in January. The City Commissioners holding office shall continue in office until their present terms of office expire and until their successors are elected and take office, unless vacancies therein otherwise occur.

(b) Eligibility. Only qualified voters of the City shall be eligible to hold office of Commissioner. No person shall run for more than one Commission seat in an election and no person shall run for Mayor and a Commission seat in the same election.

 

Section 6.01. - Election of mayor and commissioners; dates of regular and runoff elections.

(a) The regular municipal election of the City shall be held simultaneously with the State primary elections of each election year and runoff elections, if necessary, shall be held simultaneously with the State general elections of each election year after qualification is completed and after consultation with the Seminole County Supervisor of Elections.

(b) City Commission seats are hereby designated as Mayor and the remaining seats for City Commission districts 1, 2, 3, and 4. Candidates for the offices of Mayor and City Commissioner shall file to qualify for the office of Mayor or City Commission district as provided by law.

(c) Each candidate for office shall announce whether he or she is a candidate for the office of Mayor or for a City Commission district. Where more than one (1) Commissioner is to be elected, the candidates for Commissioner shall be grouped by district number and each candidate shall announce the district for which he or she is a candidate.

(d) The candidate for Mayor receiving a majority of the votes cast for Mayor shall be elected. The candidate in each district for Commissioner receiving a majority of the votes cast in that district shall be elected. In the event that no candidate for Mayor receives a majority of the votes cast for Mayor a the regular municipal election of the City held simultaneously with the State primary elections, a runoff election shall be held as provided in subsection (a), at which runoff election only the two (2) candidates for Mayor receiving the highest vote in the regular municipal election shall be candidates, and the candidate for Mayor receiving a majority of the votes cast for Mayor shall be elected. In the event that no candidate for Commissioner in a district receives a majority of the votes cast in that district at the regular municipal election held simultaneously with the State primary elections, a runoff election shall be held as provided in subsection (a), at which runoff election only the two (2) candidates for Commissioner receiving the highest vote in the regular municipal election for that district shall be candidates, and the candidate for Commissioner receiving a majority of the votes cast for Commissioner in a district shall be elected.

(e) Write-in votes shall be allowed and counted in accordance with controlling State law. The names of unopposed candidates shall not appear on the ballot when not in accordance with controlling State law.

(f) Any matter which, by the terms of this Charter may be submitted to the electors of the City at any special election may be submitted and voted upon at any City election held in accordance with this section.

 

Section 6.07. - City Commission Districts and Redistricting.

(a) Notwithstanding any other provision of this Charter the Mayor shall represent the City as a whole and be elected by electors throughout the City. Each City Commissioner shall represent a single City Commission district, shall actually physically reside in the district for which they seek office from the date of qualification for office until the expiration of the term of office for which elected and shall be elected solely by the voters of that district.

(b) There shall be a number of four (4) City Commission districts, either four (4) or six (6) in number, as determined by ordinance enacted by the City Commission, that shall be established, defined and geographically described areas of the City as defined by Ordinance Number 4032 and subsequent successor ordinances relating to City Commission redistricting as required by this Charter, general law and constitutional principles. Each district shall be formed from compact contiguous territory with the boundary lines following the centers of streets to the extent practicable. Due consideration shall be given to maintaining the geographical integrity of neighborhoods and developments within the individual districts. City Commission district lines shall be constructed so as to comply with the constitutional principles of equal and effective representation required by applicable State and Federal guidelines. The City Commission shall give due consideration to the multiple constitutional principles involved in the electoral process and shall give due regard for the opportunity of minority representation on the City Commission as a part of the redistricting process in compliance with applicable State and Federal constitutional standards.

(c) An incumbent Commissioner's seat number may change due to the realignment process occurring during redistricting. However, no incumbent Commissioner shall have a term of office cut short by the adoption of a redistricting plan.

(d) The City Commission may modify City Commission districts by the enactment of a successor ordinance under such processes, procedures and redistricting committees and/or consultants the City Commission may deem to be desirable. The City Commission shall begin the initiation of a redistricting process for City Commission districts within thirty (30) days after the receipt of the official Decennial Census data every ten (10) years so as to finalize the redistricting process one hundred fifty (150) days in advance of the first date to qualify for the next regular City election. In the event the redistricting process is not completed prior to said one hundred fifty (150) day advance period, the City Commission shall accomplish the redistricting process as soon as is reasonably possible thereafter. The official Decennial Census data shall be the authoritative source for demographical data used in reconstituting City Commission districts in compliance with applicable State and Federal standards.

 

Section 2. Ballot Question Number One. The form of the ballot for the Charter amendment provided for in Section 1 of this Ordinance shall be as follows: 1

101.161 Referenda; ballots. -

(1) Whenever a constitutional amendment or other public measure is submitted to the vote of the people, a ballot summary of such amendment or other public measure shall be printed in clear and unambiguous language on the ballot after the list of candidates, followed by the word “yes” and also by the word “no,” and shall be styled in such a manner that a “yes” vote will indicate approval of the proposal and a “no” vote will indicate rejection. The ballot summary of the amendment or other public measure and the ballot title to appear on the ballot shall be embodied in the constitutional revision commission proposal, constitutional convention proposal, taxation and budget reform commission proposal, or enabling resolution or ordinance. The ballot summary of the amendment or other public measure shall be an explanatory statement, not exceeding 75 words in length, of the chief purpose of the measure. In addition, for every amendment proposed by initiative, the ballot shall include, following the ballot summary, a separate financial impact statement concerning the measure prepared by the Financial Impact Estimating Conference in accordance with s. 100.371(5). The ballot title shall consist of a caption, not exceeding 15 words in length, by which the measure is commonly referred to or spoken of. This subsection does not apply to constitutional amendments or revisions proposed by joint resolution.

(2) The ballot summary and ballot title of a constitutional amendment proposed by initiative shall be prepared by the sponsor and approved by the Secretary of State in accordance with rules adopted pursuant to s. 120.54. The Department of State shall give each proposed constitutional amendment a designating number for convenient reference. This number designation shall appear on the ballot. Designating numbers shall be assigned in the order of filing or certification and in accordance with rules adopted by the Department of State. The Department of State shall furnish the designating number, the ballot title, and, unless otherwise specified in a joint resolution, the ballot summary of each amendment to the supervisor of elections of each county in which such amendment is to be voted on.

(3)(a) Each joint resolution that proposes a constitutional amendment or revision shall include one or more ballot statements set forth in order of priority. Each ballot statement shall consist of a ballot title, by which the measure is commonly referred to or spoken of, not exceeding 15 words in length, and a ballot summary that describes the chief purpose of the amendment or revision in clear and unambiguous language. If a joint resolution that proposes a constitutional amendment or revision contains only one ballot statement, the ballot summary may not exceed 75 words in length. If a joint resolution that proposes a constitutional amendment or revision contains more than one ballot statement, the first ballot summary, in order of priority, may not exceed 75 words in length.

(b) The Department of State shall furnish a designating number pursuant to subsection (2) and the appropriate ballot statement to the supervisor of elections of each county. The ballot statement shall be printed on the ballot after the list of candidates, followed by the word “yes” and also by the word “no,” and shall be styled in such a manner that a “yes” vote will indicate approval of the amendment or revision and a “no” vote will indicate rejection.

(c)1. Any action for a judicial determination that one or more ballot statements embodied in a joint resolution are defective must be commenced by filing a complaint or petition with the appropriate court within 30 days after the joint resolution is filed with the Secretary of State. The complaint or petition shall assert all grounds for challenge to each ballot statement. Any ground not asserted within 30 days after the joint resolution is filed with the Secretary of State is waived.

2. The court, including any appellate court, shall accord an action described in subparagraph 1. priority over other pending cases and render a decision as expeditiously as possible. If the court finds that all ballot statements embodied in a joint resolution are defective and further appeals are declined, abandoned, or exhausted, unless otherwise provided in the joint resolution, the Attorney General shall, within 10 days, prepare and submit to the Department of State a revised ballot title or ballot summary that corrects the deficiencies identified by the court, and the Department of State shall furnish a designating number and the revised ballot title or ballot summary to the supervisor of elections of each county for placement on the ballot. The revised ballot summary may exceed 75 words in length. The court shall retain jurisdiction over challenges to a revised ballot title or ballot summary prepared by the Attorney General, and any challenge to a revised ballot title or ballot summary must be filed within 10 days after a revised ballot title or ballot summary is submitted to the Department of State.

(4)(a) For any general election in which the Secretary of State, for any circuit, or the supervisor of elections, for any county, has certified the ballot position for an initiative to change the method of selection of judges, the ballot for any circuit must contain the statement in paragraph (b) or paragraph (c) and the ballot for any county must contain the statement in paragraph (d) or paragraph (e).

(b) In any circuit where the initiative is to change the selection of circuit court judges to selection by merit selection and retention, the ballot shall state: “Shall the method of selecting circuit court judges in the   (number of the circuit)   judicial circuit be changed from election by a vote of the people to selection by the judicial nominating commission and appointment by the Governor with subsequent terms determined by a retention vote of the people?” This statement must be followed by the word “yes” and also by the word “no.”

Section 6.02. - Same—Qualifications of candidates; form of oath.

(a) Any person who is a qualified elector in the City of Sanford, not a convicted felon whose civil rights have not been restored and who is otherwise qualified, may become a candidate for the office of Mayor or City Commissioner upon filing with the City Clerk a written notice of his or her intention to become a candidate in accordance with Article II and this Section, requesting that his or her name be printed upon the ballot and depositing with such written notice a sum equal to five percent (5%) of the then effective annual salary of the office the candidate seeks plus the costs of any applicable state mandated election fees as a qualifying fee for the office sought. All 5% qualification fees shall be placed in the general fund of the City of Sanford and allocated toward the cost of City elections. State election fees shall be transferred to the State of Florida as provided by general State law.

(b) The period within which a candidate may qualify as above stated shall begin ninety-two (92) days prior to the election and shall terminate at 12:00 noon on the last fifth regular working day for the City Clerk's office eighty-eight (88) days in advance of the election date. Qualification can be effected only during normal working hours for the City Clerk's office.

 

Persons who are in line at the termination of the qualification period shall be permitted to submit their papers that are available at that time in an attempt to qualify.

(c) Any person who is a qualified elector in the City of Sanford, and otherwise qualified, may alternatively become a candidate for the office of Mayor or City Commissioner upon filing with the City Clerk a written notice of his or her intention to become a candidate in accordance with Article II and this Section, requesting that his or her name be printed upon the ballot and presenting a written petition with the names of two hundred and fifty (250) signers who are eligible electors residing in the Commission district seat the candidate seeks. Candidates for Mayor qualifying by petition shall present a written petition with the names of five hundred (500) signers who are eligible voters residing within the City. The form of the petition shall comply with Florida law. Petitions for placing a candidate's name on the ballot may be submitted to the City Clerk for verification in whole or in part. Candidates qualifying by petition may begin collecting and turning in names on petitions one hundred and twenty (120) days in advance of the opening of the qualifying period. All petitions for placing a candidate's name on the ballot must be received by the City Clerk's office prior to the end of the qualifying period. The City Clerk shall present the names on written qualification petitions to the supervisor of elections office for certification as a valid elector and shall provide timely notification of the number of certified electors to the candidate until the requisite number of electors has been met or the qualification period has ended with the candidate being unable to meet the required numbers of certified electors during their qualification petition attempt.

(d) The costs, as required by State law, of elector certifications shall be paid to the City Clerk by the individual candidate(s) requesting the certification as a part of the qualifying procedures.

(e) The City Clerk shall verify the residency of candidates for Mayor and the City Commission district seats. Candidates shall reside in the district for which he or she seeks to qualify and shall sign an affidavit of residency and shall provide suitable documents establishing his or her residency as a part of the qualification process. Documents that shall suffice to serve as authoritative proof of residency include, but are not limited to, driver's licenses, homestead exemption documents, passports, voter identification cards, other governmental identification cards and utilities bills. Elected Commissioners for the Commission shall physically reside in the district they are elected to represent or reside in the district they seek to represent.

(f) It is understood that emergency exigent circumstances may arise from time to time.

(g) Should an exigent circumstance cause the physical place of abode of a Commissioner to be uninhabitable or destroyed and he or she is forced to take up temporary abode elsewhere within the City, then and in that event:

(1) The Commissioner/candidate shall make reasonable efforts to relocate within his or her elective district.

(2) Failing such effort, the Commissioner/candidate must seek the approval of the City Commission to temporarily reside outside his or her elected district.

(3) Commission authority for a Commissioner/candidate to reside out of district shall be granted for such reasonable period as a valid exigent temporary relocation requirement exists as determined by the Commission.

(4) Requests for extension shall be heard and acted upon by the Commission giving attendance to all exigent circumstances.

(h) Any person who is a resident of the City and has qualified as an elector therein may become a candidate for the office of Mayor or Commissioner by qualifying as described above and taking and subscribing to an oath or affirmation in substantially the form as required by the general laws of Florida.

Section 6.03. - Names to be placed on ballot for regular election.

The names of all candidates for the office of mayor shall be placed on the election ballot first and in alphabetical order.

The names of all candidates for commission seats shall be placed upon the regular election ballot in alphabetical order for commission seat to be voted upon. Commission seats shall be listed on the ballot in their numerical order.

Runoff election ballots shall be in the same form as prescribed herein for the regular municipal election ballot.

 

Section 6.05. - Absentee voting.

Absentee voting shall be permitted in city elections in the same manner as may be provided in state elections.

 

Section 6.06. - Qualification of electors; prescribing method and manner of election.

No person shall be allowed to vote at any election for the purpose of electing City Commissioners and Mayor for said city who is not a qualified voter under the State law. The City Commission shall, by ordinance, prescribe the method and manner of holding all elections which shall be called and held and which are not provided for by the terms of this Charter. All City such elections shall be conducted substantially on the principal adopted for the State elections insofar as there is no conflict with the terms of this charter; provided, that the city commission may, by ordinance, prescribe the method, manner and conduct of all elections of said city not in conflict with this charter. The City Clerk, with the approval of the City Manager, shall adopt rules and procedure relating to the administration and implementation of City elections and all provisions of the City Code on the effective date of this amendment shall be addressed by the City Manager and may be administratively repealed and deleted from the City Code and the City Clerk may adopt rules to replace such provisions of the City Code. All rules to be adopted by the City Clerk shall be presented to the City Commission for approval prior to the rules taking effect.

 

Section 4. Ballot Question Number Two. The form of the ballot for the Charter amendment provided for in Section 3 of this Ordinance shall be as follows:

Section 5. Proposed Revision Of Section 2.01 And Section 6.04, City Charter; Date Of Taking Office. Section 2.01 and Section 6.04 of the Charter of the City of Sanford, Florida, are proposed to be amended to read as follows:

 

Section 2.01. - Composition, terms, and eligibility.

(a) City Commission. That there is hereby created a City Commission of the City of Sanford, Florida to consist of five (5) members; four (4) commissioners and a mayor, who shall also be known as a commissioner, each of whom shall be elected for a term of four (4) years both commencing and terminating on the second fourth Monday in December January. The City Commissioners holding office shall continue in office until their present terms of office expire and until their successors are elected and take office, unless vacancies therein otherwise occur. (b) Eligibility. Only qualified voters of the City shall be eligible to hold office of commissioner. No person shall run for more than one commission seat in an election and no person shall run for mayor and a commission seat in the same election.

 

Section 6.04. - Commission to declare person elected/commencement of term of office.

All candidates elected as Mayor or as City Commissioner by regular or runoff election as provided in Section 6.01 shall take office on the second fourth Monday in December January immediately following the regular or runoff election at which successful candidates are determined. All candidates elected by special election shall take office after certification of the election results by the Commission.

 

Transition.

The City Commissioners seated on the effective date of this Charter amendment shall continue to serve through their current terms of office. City Commissioners elected in 2020 shall have terms of office which terminate consistent with this Charter amendment.

 

Section 6. Ballot Question Number Three. The form of the ballot for the Charter amendment provided for in Section 5 of this Ordinance shall be as follows:

Section 7. Proposed Revision Of Section 2.02, City Charter; Compensation/Expenses. Section 2.02 of the Charter of the City of Sanford, Florida, are proposed to be amended to read as follows:

 

Section 2.02. - Compensation; expenses.

The commission may determine the annual salary of Mayor and City Commissioners shall receive for their services reasonable annual compensation which shall be the salary authorized by Section 145.031, Florida Statutes, or its successor provision; provided, however, that the calculation shall be for population Group III base multiplied by 56.7 percent for the Mayor and multiplied by 46.7 percent for City Commissioners, and future adjustments, but  without any adjustment being made based upon State employee pay increases as may be approved by the Florida Legislature.by ordinance, but no ordinance increasing such salary shall become effective until the date of commencement of the terms of commissioners elected at the next regular election. The Mayor and City Commissioners shall receive their expenses in the performance of their duties of office in accordance with Section 112.061, Florida Statutes, relating to per diem and travel expenses of public officers, employees, or its successor provisions, or the City's policy relative to travel pertaining to City employees which shall prevail in the event of a conflict. The formula set forth herein is as follows: Base Salary(as determined by the population group rate chart) + (City’s current population - population Group Minimum from the population group rate chart) x Group Rate from the population group rate chart)x Initial Factor (referenced in Section 145.19(2)(c), Florida Statutes) x Certified Annual Factor (Determined by the State annually and referenced in Section 145.19, Florida Statutes) x Certified Cumulative Annual Factor (Determined by the State annually and referenced in Section 145.19, Florida Statutes) x 46.7 percent for a Commissioner or x 56.7 percent for the Mayor.

145.031           Board of county commissioners.—

(1)        Each member of the board of county commissioners shall receive as salary the amount indicated, based on the population of his or her county. In addition, compensation shall be made for population increments over the minimum for each population group, which shall be determined by multiplying the population in excess of the minimum for the grouping times the group rate.

(2)        No member of a governing body of a chartered county or a county with a consolidated form of government shall be deemed to be the equivalent of a county commissioner for the purposes of determining the compensation of such member under his or her respective charter.

(3)        Notwithstanding the provisions of this section or s. 145.19, each member of the board of county commissioners may reduce his or her salary rate on a voluntary basis.

 

145.19 Annual percentage increases based on increase for state career service employees; limitation.—

(1)        As used in this section, the term:

(a)        “Annual factor” means 1 plus the lesser of:

1.         The average percentage increase in the salaries of state career service employees for the current fiscal year as determined by the Department of Management Services or as provided in the General Appropriations Act; or

2.         Seven percent.

(b)        “Cumulative annual factor” means the product of all annual factors certified under this act prior to the fiscal year for which salaries are being calculated.

(c)        “Initial factor” means a factor of 1.292, which is a product, rounded to the nearest thousandth, of an earlier cost-of-living increase factor authorized by chapter 73-173, Laws of Florida, and intended by the Legislature to be preserved in adjustments to salaries made prior to enactment of chapter 76-80, Laws of Florida, multiplied by the annual increase factor authorized by chapter 79-327, Laws of Florida.

(2)        Each fiscal year, the salaries of all officials listed in this chapter, s. 1001.395, and s. 1001.47 shall be adjusted. The adjusted salary rate shall be the product, rounded to the nearest dollar, of the salary rate granted by the appropriate section of this chapter, s. 1001.395, or s. 1001.47 multiplied first by the initial factor, then by the cumulative annual factor, and finally by the annual factor. The Department of Management Services shall certify the annual factor and the cumulative annual factors. Any special qualification salary received under this chapter, s. 1001.47, or the annual performance salary incentive available to elected superintendents under s. 1001.47 shall be added to such adjusted salary rate. The special qualification salary shall be $2,000, but shall not exceed $2,000.

 

112.061           Per diem and travel expenses of public officers, employees, and authorized persons.—

(1)        LEGISLATIVE INTENT.—To prevent inequities, conflicts, inconsistencies, and lapses in the numerous laws regulating or attempting to regulate travel expenses of public officers, employees, and authorized persons in the state, it is the intent of the Legislature:

(a)        To establish standard travel reimbursement rates, procedures, and limitations, with certain justifiable exceptions and exemptions, applicable to all public officers, employees, and authorized persons whose travel is authorized and paid by a public agency.

(b)        To preserve the standardization established by this law:

1.         The provisions of this section shall prevail over any conflicting provisions in a general law, present or future, to the extent of the conflict; but if any such general law contains a specific exemption from this section, including a specific reference to this section, such general law shall prevail, but only to the extent of the exemption.

2.         The provisions of any special or local law, present or future, shall prevail over any conflicting provisions in this section, but only to the extent of the conflict.

(2)        DEFINITIONS.—For the purposes of this section, the following words shall have the meanings indicated:

(a)        Agency or public agency—Any office, department, agency, division, subdivision, political subdivision, board, bureau, commission, authority, district, public body, body politic, county, city, town, village, municipality, or any other separate unit of government created pursuant to law.

(b)        Agency head or head of the agency—The highest policymaking authority of a public agency, as herein defined.

(c)        Officer or public officer—An individual who in the performance of his or her official duties is vested by law with sovereign powers of government and who is either elected by the people, or commissioned by the Governor and has jurisdiction extending throughout the state, or any person lawfully serving instead of either of the foregoing two classes of individuals as initial designee or successor.

(d)        Employee or public employee—An individual, whether commissioned or not, other than an officer or authorized person as defined herein, who is filling a regular or full-time authorized position and is responsible to an agency head.

(e)        Authorized person—

1.         A person other than a public officer or employee as defined herein, whether elected or commissioned or not, who is authorized by an agency head to incur travel expenses in the performance of official duties.

2.         A person who is called upon by an agency to contribute time and services as consultant or adviser.

3.         A person who is a candidate for an executive or professional position.

(f)        Traveler—A public officer, public employee, or authorized person, when performing authorized travel.

(g)        Travel expense, traveling expenses, necessary expenses while traveling, actual expenses while traveling, or words of similar nature—The usual ordinary and incidental expenditures necessarily incurred by a traveler.

(h)        Common carrier—Train, bus, commercial airline operating scheduled flights, or rental cars of an established rental car firm.

(i)         Travel day—A period of 24 hours consisting of four quarters of 6 hours each.

(j)         Travel period—A period of time between the time of departure and time of return.

(k)        Class A travel—Continuous travel of 24 hours or more away from official headquarters.

(l)         Class B travel—Continuous travel of less than 24 hours which involves overnight absence from official headquarters.

(m)      Class C travel—Travel for short or day trips where the traveler is not away from his or her official headquarters overnight.

(n)        Foreign travel—Travel outside the United States.

(3)        AUTHORITY TO INCUR TRAVEL EXPENSES.—

(a)        All travel must be authorized and approved by the head of the agency, or his or her designated representative, from whose funds the traveler is paid. The head of the agency shall not authorize or approve such a request unless it is accompanied by a signed statement by the traveler’s supervisor stating that such travel is on the official business of the state and also stating the purpose of such travel.

(b)        Travel expenses of travelers shall be limited to those expenses necessarily incurred by them in the performance of a public purpose authorized by law to be performed by the agency and must be within the limitations prescribed by this section.

(c)        Travel by public officers or employees serving temporarily in behalf of another agency or partly in behalf of more than one agency at the same time, or authorized persons who are called upon to contribute time and services as consultants or advisers, may be authorized by the agency head. Complete explanation and justification must be shown on the travel expense voucher or attached thereto.

(d)        Travel expenses of public employees for the sole purpose of taking merit system or other job placement examinations, written or oral, shall not be allowed under any circumstances, except that upon prior written approval of the agency head or his or her designee, candidates for executive or professional positions may be allowed travel expenses pursuant to this section.

(e)        Travel expenses of public officers or employees for the purpose of implementing, organizing, directing, coordinating, or administering, or supporting the implementation, organization, direction, coordination, or administration of, activities related to or involving travel to a terrorist state shall not be allowed under any circumstances. For purposes of this section, “terrorist state” is defined as any state, country, or nation designated by the United States Department of State as a state sponsor of terrorism.

 

(f)        The agency head, or a designated representative, may pay by advancement or reimbursement, or a combination thereof, the costs of per diem of travelers for foreign travel at the current rates as specified in the federal publication “Standardized Regulations (Government Civilians, Foreign Areas)” and incidental expenses as provided in this section.

(g)        A traveler who becomes sick or injured while away from his or her official headquarters and is therefore unable to perform the official business of the agency may continue to receive subsistence as provided in subsection (6) during this period of illness or injury until such time as he or she is able to perform the official business of the agency or

returns to his or her official headquarters, whichever is earlier. Such subsistence may be paid when approved by the agency head or his or her designee.

(h)        The State Surgeon General or a designee may authorize travel expenses incidental to the rendering of medical services for and on behalf of clients of the Department of Health. The Department of Health may establish rates lower than the rate provided in this section for these travel expenses.

(4)        OFFICIAL HEADQUARTERS.—The official headquarters of an officer or employee assigned to an office shall be the city or town in which the office is located except that:

(a)        The official headquarters of a person located in the field shall be the city or town nearest to the area where the majority of the person’s work is performed, or such other city, town, or area as may be designated by the agency head provided that in all cases such designation must be in the best interests of the agency and not for the convenience of the person.

(b)        When any state employee is stationed in any city or town for a period of over 30 continuous workdays, such city or town shall be deemed to be the employee’s official headquarters, and he or she shall not be allowed per diem or subsistence, as provided in this section, after the said period of 30 continuous workdays has elapsed, unless this period of time is extended by the express approval of the agency head or his or her designee.

(c)        A traveler may leave his or her assigned post to return home overnight, over a weekend, or during a holiday, but any time lost from regular duties shall be taken as annual leave and authorized in the usual manner. The traveler shall not be reimbursed for travel expenses in excess of the established rate for per diem allowable had he or she remained at his or her assigned post. However, when a traveler has been temporarily assigned away from his or her official headquarters for an approved period extending beyond 30 days, he or she shall be entitled to reimbursement for travel expenses at the established rate of one round trip for each 30-day period actually taken to his or her home in addition to pay and allowances otherwise provided.

(5)        COMPUTATION OF TRAVEL TIME FOR REIMBURSEMENT.—For purposes of reimbursement and methods of calculating fractional days of travel, the following principles are prescribed:

(a)        The travel day for Class A travel shall be a calendar day (midnight to midnight). The travel day for Class B travel shall begin at the same time as the travel period. For Class A and Class B travel, the traveler shall be reimbursed one-fourth of the authorized rate of per diem for each quarter, or fraction thereof, of the travel day included within the travel period. Class A and Class B travel shall include any assignment on official business outside of regular office hours and away from regular places of employment when it is considered reasonable and necessary to stay overnight and for which travel expenses are approved.

(b)        A traveler shall not be reimbursed on a per diem basis for Class C travel, but shall receive subsistence as provided in this section, which allowance for meals shall be based on the following schedule:

1.         Breakfast—When travel begins before 6 a.m. and extends beyond 8 a.m.

2.         Lunch—When travel begins before 12 noon and extends beyond 2 p.m.

3.         Dinner—When travel begins before 6 p.m. and extends beyond 8 p.m., or when travel occurs during nighttime hours due to special assignment.

No allowance shall be made for meals when travel is confined to the city or town of the official headquarters or immediate vicinity; except assignments of official business outside the traveler’s regular place of employment if travel expenses are approved. The Chief Financial Officer shall establish a schedule for processing Class C travel subsistence payments at least on a monthly basis.

(6)        RATES OF PER DIEM AND SUBSISTENCE ALLOWANCE.—For purposes of reimbursement rates and methods of calculation, per diem and subsistence allowances are provided as follows:

(a)        All travelers shall be allowed for subsistence when traveling to a convention or conference or when traveling within or outside the state in order to conduct bona fide state business, which convention, conference, or business serves a direct and lawful public purpose with relation to the public agency served by the person attending such meeting or conducting such business, either of the following for each day of such travel at the option of the traveler:

1.         Eighty dollars per diem; or

2.         If actual expenses exceed $80, the amounts permitted in paragraph (b) for subsistence, plus actual expenses for lodging at a single-occupancy rate to be substantiated by paid bills therefor.

When lodging or meals are provided at a state institution, the traveler shall be reimbursed only for the actual expenses of such lodging or meals, not to exceed the maximum provided for in this subsection.

 

(b)        All travelers shall be allowed the following amounts for subsistence while on Class C travel on official business as provided in paragraph (5)(b):

1.         Breakfast..........$6

2.         Lunch..........$11

3.         Dinner..........$19

(c)        No one, whether traveling out of state or in state, shall be reimbursed for any meal or lodging included in a convention or conference registration fee paid by the state.

(7)        TRANSPORTATION.—

(a)        All travel must be by a usually traveled route. In case a person travels by an indirect route for his or her own convenience, any extra costs shall be borne by the traveler; and reimbursement for expenses shall be based only on such charges as would have been incurred by a usually traveled route. The agency head or his or her designee shall designate the most economical method of travel for each trip, keeping in mind the following conditions:

1.         The nature of the business.

2.         The most efficient and economical means of travel (considering time of the traveler, impact on the productivity of the traveler, cost of transportation, and per diem or subsistence required). When it is more efficient and economical to either the traveler or the agency head, jet service offered by any airline, whether on state contract or not, may be used when the cost is within an approved threshold determined by the agency head or his or her designee.

3.         The number of persons making the trip and the amount of equipment or material to be transported.

(b)        The Department of Financial Services may provide any form it deems necessary to cover travel requests for traveling on official business and when paid by the state.

(c)        Transportation by common carrier when traveling on official business and paid for personally by the traveler, shall be substantiated by a receipt therefor. Federal tax shall not be reimbursable to the traveler unless the state and other public agencies are also required by federal law to pay such tax. In the event transportation other than the most economical class as approved by the agency head is provided by a common carrier on a flight check or credit card, the charges in excess of the most economical class shall be refunded by the traveler to the agency charged with the transportation provided in this manner.

(d)1.     The use of privately owned vehicles for official travel in lieu of publicly owned vehicles or common carriers may be authorized by the agency head or his or her designee. Whenever travel is by privately owned vehicle:

a.         A traveler shall be entitled to a mileage allowance at a rate of 44.5 cents per mile; or

b.         A traveler shall be entitled to the common carrier fare for such travel if determined by the agency head to be more economical.

2.         Reimbursement for expenditures related to the operation, maintenance, and ownership of a vehicle shall not be allowed when privately owned vehicles are used on public business and reimbursement is made pursuant to this paragraph, except as provided in subsection (8).

3.         All mileage shall be shown from point of origin to point of destination and, when possible, shall be computed on the basis of the current map of the Department of Transportation. Vicinity mileage necessary for the conduct of official business is allowable but must be shown as a separate item on the expense voucher.

(e)        Transportation by chartered vehicles when traveling on official business may be authorized by the agency head when necessary or where it is to the advantage of the agency, provided the cost of such transportation does not exceed the cost of transportation by privately owned vehicle pursuant to paragraph (d).

(f)        The agency head or his or her designee may grant monthly allowances in fixed amounts for use of privately owned automobiles on official business in lieu of the mileage rate provided in paragraph (d). Allowances granted pursuant to this paragraph shall be reasonable, taking into account the customary use of the automobile, the roads customarily traveled, and whether any of the expenses incident to the operation, maintenance, and ownership of the automobile are paid from funds of the agency or other public funds. Such allowance may be changed at any time, and shall be made on the basis of a signed statement of the traveler, filed before the allowance is granted or changed, and at least annually thereafter. The statement shall show the places and distances for an average typical month’s travel on official business, and the amount that would be allowed under the approved rate per mile for the travel shown in the statement, if payment had been made pursuant to paragraph (d).

(g)        No contract may be entered into between a public officer or employee, or any other person, and a public agency, in which a depreciation allowance is used in computing the amount due by the agency to the individual for the use of a privately owned vehicle on official business; provided, any such existing contract shall not be impaired.

(h)        No traveler shall be allowed either mileage or transportation expense when gratuitously transported by another person or when transported by another traveler who is entitled to mileage or transportation expense. However, a traveler on a private aircraft shall be reimbursed the actual amount charged and paid for the fare for such transportation up to the cost of a commercial airline ticket for the same flight, even though the owner or pilot of such aircraft is also entitled to transportation expense for the same flight under this subsection.

(8)        OTHER EXPENSES.—

(a)        The following incidental travel expenses of the traveler may be reimbursed:

1.         Taxi fare.

2.         Ferry fares; and bridge, road, and tunnel tolls.

3.         Storage or parking fees.

4.         Communication expense.

5.         Convention registration fee while attending a convention or conference which will serve a direct public purpose with relation to the public agency served by the person attending such meetings. A traveler may be reimbursed the actual and necessary fees for attending events which are not included in a basic registration fee that directly enhance the public purpose of the participation of the agency in the conference. Such expenses may include, but not be limited to, banquets and other meal functions. It shall be the responsibility of the traveler to substantiate that the charges were proper and necessary. However, any meals or lodging included in the registration fee will be deducted in accordance with the allowances provided in subsection (6).

(b)        Other expenses which are not specifically authorized by this section may be approved by the Department of Financial Services pursuant to rules adopted by it. Expenses approved pursuant to this paragraph shall be reported by the Department of Financial Services to the Auditor General annually.

(9)        RULES.—

(a)        The Department of Financial Services shall adopt such rules, including, but not limited to, the general criteria to be used by a state agency to predetermine justification for attendance by state officers and employees and authorized persons at conventions and conferences, and prescribe such forms as are necessary to effectuate the purposes of this section. The department may also adopt rules prescribing the proper disposition and use of promotional items and rebates offered by common carriers and other entities in connection with travel at public expense; however, before adopting such rules, the department shall consult with the appropriation committees of the Legislature.

(b)        Each state agency shall adopt such additional specific rules and specific criteria to be used by it to predetermine justification for attendance by state officers and employees and authorized persons at conventions and conferences, not in conflict with the rules of the Department of Financial Services or with the general criteria to be used by a state agency to predetermine justification for attendance by state officers and employees and authorized persons at conventions, as may be necessary to effectuate the purposes of this section.

(10)      FRAUDULENT CLAIMS.—Claims submitted pursuant to this section shall not be required to be sworn to before a notary public or other officer authorized to administer oaths, but any claim authorized or required to be made under any provision of this section shall contain a statement that the expenses were actually incurred by the traveler as necessary travel expenses in the performance of official duties and shall be verified by a written declaration that it is true and correct as to every material matter; and any person who willfully makes and subscribes any such claim which he or she does not believe to be true and correct as to every material matter, or who willfully aids or assists in, or procures, counsels, or advises the preparation or presentation under the provisions of this section of a claim which is fraudulent or is false as to any material matter, whether or not such falsity or fraud is with the knowledge or consent of the person authorized or required to present such claim, is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. Whoever shall receive an allowance or reimbursement by means of a false claim shall be civilly liable in the amount of the overpayment for the reimbursement of the public fund from which the claim was paid.

(11)      TRAVEL AUTHORIZATION AND VOUCHER FORMS.—

(a)        Authorization forms.—The Department of Financial Services shall furnish a uniform travel authorization request form which shall be used by all state officers, employees, and authorized persons when requesting approval for the performance of travel to a convention or conference. The form shall include, but not be limited to, provision for the name of each traveler, purpose of travel, period of travel, estimated cost to the state, and a statement of benefits accruing to the state by virtue of such travel. A copy of the program or agenda of the convention or conference, itemizing registration fees and any meals or lodging included in the registration fee, shall be attached to, and filed with, the copy of the travel authorization request form on file with the agency. The form shall be signed by the traveler and by the traveler’s supervisor stating that the travel is to be incurred in connection with official business of the state. The head of the agency or his or her designated representative shall not authorize or approve such request in the absence of the appropriate signatures. A copy of the travel authorization form shall be attached to, and become a part of, the support of the agency’s copy of the travel voucher.

(b)        Voucher forms.—

1.         The Department of Financial Services shall furnish a uniform travel voucher form which shall be used by all state officers, employees, and authorized persons when submitting travel expense statements for approval and payment. No travel expense statement shall be approved for payment by the Chief Financial Officer unless made on the form prescribed and furnished by the department. The travel voucher form shall provide for, among other things, the purpose of the official travel and a certification or affirmation, to be signed by the traveler, indicating the truth and correctness of the claim in every material matter, that the travel expenses were actually incurred by the traveler as necessary in the performance of official duties, that per diem claimed has been appropriately reduced for any meals or lodging included in the convention or conference registration fees claimed by the traveler, and that the voucher conforms in every respect with the requirements of this section. The original copy of the executed uniform travel authorization request form shall be attached to the uniform travel voucher on file with the respective agency.

2.         Statements for travel expenses incidental to the rendering of medical services for and on behalf of clients of the Department of Health shall be on forms approved by the Department of Financial Services.

(12)      ADVANCEMENTS.—Notwithstanding any of the foregoing restrictions and limitations, an agency head or his or her designee may make, or authorize the making of, advances to cover anticipated costs of travel to travelers. Such advancements may include the costs of subsistence and travel of any person transported in the care or custody of the traveler in the performance of his or her duties.

(13)      DIRECT PAYMENT OF EXPENSES BY AGENCY.—Whenever an agency requires an employee to incur either Class A or Class B travel on emergency notice to the traveler, such traveler may request the agency to pay his or her expenses for meals and lodging directly to the vendor, and the agency may pay the vendor the actual expenses for meals and lodging during the travel period, limited to an amount not to exceed that authorized pursuant to this section. In emergency situations, the agency head or his or her designee may authorize an increase in the amount paid for a specific meal, provided that the total daily cost of meals does not exceed the total amount authorized for meals each day. The agency head or his or her designee may also grant prior approval for a state agency to make direct payments of travel expenses in other situations that result in cost savings to the state, and such cost savings shall be documented in the voucher submitted to the Chief Financial Officer for the direct payment of travel expenses. The provisions of this subsection shall not be deemed to apply to any legislator or to any employee of the Legislature.

(14)      APPLICABILITY TO COUNTIES, COUNTY OFFICERS, DISTRICT SCHOOL BOARDS, SPECIAL DISTRICTS, AND METROPOLITAN PLANNING ORGANIZATIONS.—

(a) The following entities may establish rates that vary from the per diem rate provided in paragraph (6)(a), the subsistence rates provided in paragraph (6)(b), or the mileage rate provided in paragraph (7)(d) if those rates are not less than the statutorily established rates that are in effect for the 2005-2006 fiscal year:

1.         The governing body of a county by the enactment of an ordinance or resolution;

2.         A county constitutional officer, pursuant to s. 1(d), Art. VIII of the State Constitution, by the establishment of written policy;

3.         The governing body of a district school board by the adoption of rules;

4.         The governing body of a special district, as defined in s. 189.012, except those special districts that are subject to s. 166.021(9), by the enactment of a resolution; or

5.         Any metropolitan planning organization created pursuant to s. 339.175 or any other separate legal or administrative entity created pursuant to s. 339.175 of which a metropolitan planning organization is a member, by the enactment of a resolution.

(b)        Rates established pursuant to paragraph (a) must apply uniformly to all travel by the county, county constitutional officer and entity governed by that officer, district school board, special district, or metropolitan planning organization.

(c)        Except as otherwise provided in this subsection, counties, county constitutional officers and entities governed by those officers, district school boards, special districts, and metropolitan planning organizations, other than those subject to s. 166.021(9), remain subject to the requirements of this section.

(15)      CLASS C TRAVEL.—Moneys appropriated from the State Treasury may not be used to pay per diem or subsistence related to Class C travel.

 

Section 8.     Ballot Question Number Four.    The form of the ballot for the Charter amendment provided for in Section 7 of this Ordinance shall be as follows:

 

Compensation And Expenses For Elected Offices.

 

An amendment to amend the Sanford City Charter to require that the compensation and expenses paid to City elected officials is tied to a formula and rates set forth in State statutes is proposed.

Section 9. Referendum Election.

 

A referendum election is hereby called to be held August 28, 2018, to present to the electors of the City of Sanford the ballot question provided for in this Ordinance. The Supervisor of Elections of Seminole County is hereby requested to coordinate all matters relating to the said referendum election with the City Clerk, the Division of Elections of the Florida Department of State, and the City Manager, City Clerk and City Attorney.

 

Section 10. Appreciation For Work Of Charter Review Committee.

 

The City Commission hereby expresses its appreciation for the diligence, public service and high quality work of the Charter Review Committee.

 

Section 11. Duties Of City Clerk.

 

The City Clerk is hereby directed to ensure that the advertising and notice requirements of Section 100.342, Florida Statutes, are complied with and to coordinate all activities necessary to conduct the referendum election called in this Ordinance with the Supervisor of Elections for Seminole County.

 

Section 12. Revised Charter Of The City Of Sanford.

 

If the proposed amendments to the Charter of the City of Sanford is approved by the electorate in the referendum election called for in this Ordinance, it is the intention of the City Council, and it is hereby ordained, that the approved provisions of this Ordinance shall become and be made a part of the Charter of the City of Sanford. The City’s Code codifier is granted broad and liberal power and authority to codify the Charter of the City of Sanford in terms of making appropriate harmonizing, technical or editorial changes and notes that do not affect the substantive provisions thereof.

 

Section 13. Severability.

 

Should any section, paragraph, sentence, clause, phrase or other part of this Ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this Ordinance as a whole or any portion thereof, other than the part so declared to be invalid.

 

Section 14. Effective Date.

 

The provisions of this Ordinance shall take effect immediately upon enactment. The amendments to the Charter of the City of Sanford proposed for approval in this Ordinance shall become effective only upon approval at a referendum election of the electors of the City of Sanford in accordance with the provisions of Section 166.031, Florida Statutes.

Una ordenanza de la Ciudad de Sanford, Florida convocando a una elección de referéndum el 28 de agosto del 2018 con el propósito de proponer al electorado de la Ciudad de Sanford varias revisiones a la Carta de la Ciudad de Sanford relacionadas con los distritos de la Comisión Municipal y redistribución de distritos. (Sección 2.01, Sección 6.01 y Sección 6.07), elecciones (Artículo VI, Sección 6.01, Sección 6.02, Sección 6.03, Sección 6.05 y Sección 6.06), fecha de toma de posesión de cargo (Sección 2.01 y Sección 6.04), compensación y gastos (Sección 2.02) y el Secretario  Municipal (Sección 2.08), así como una transición; establecer el lenguaje en las papeletas; establecer los deberes del Secretario  Municipal; incluir la expresión de agradecimiento por la labor del Comité de Revisión de la Carta; establecer la inclusión en la Carta de la Ciudad de Sanford y los poderes y la autoridad para el codificador de código; proveer para la divisibilidad y proveer la fecha de vigencia de la ordenanza y la fecha de vigencia de las enmiendas propuestas a la Carta.

 

Considerando que, la ley Estatal dominante y la Carta de la Ciudad de Sanford, Florida,  proveen medios alternativos mediante los cuales se puede enmendar la Carta de la Ciudad; y

Considerando que, la Comisión Municipal de la Ciudad de Sanford adoptó la Resolución Número 2017-2681 y creó el Comité de Revisión de la Carta para formular recomendaciones para posibles enmiendas propuestas a ciertas disposiciones de la Carta de la Ciudad de Sanford, Florida; y

 

Considerando que, la Comisión Municipal de la Ciudad de Sanford designó miembros para el Comité de Revisión de la Carta y le asignó al Comité varias disposiciones de la Carta de la Ciudad de Sanford, Florida para revisar y evaluar, y hacer recomendaciones relacionadas según sea necesario; y

 

Considerando que, la Comisión Municipal adoptó la Resolución Número 2017-2695, revisando el periodo de tiempo para que el Comité de Revisión de la Carta emprenda su revisión de la Carta de la Ciudad de Sanford, Florida; y

 

Considerando que, el Comité de Revisión de la Carta se ha reunido de acuerdo a la dirección de la Comisión Municipal, desarrolló, y por la presente recomienda que las siguientes enmiendas propuestas a la Carta de la Ciudad de Sanford, Florida se presenten a los electores de la Ciudad de Sanford en una elección de referéndum celebrada de conformidad con la Carta de la Ciudad de Sanford, Florida y la ley Estatal aplicable; y

 

Considerando que, el Comité de Revisión de la Carta también expresó sus puntos de vista en cuanto a otros asuntos que involucran al gobierno de la Ciudad; y

 

Considerando que, la Comisión Municipal de la Ciudad de Sanford ha concluido que es en el mejor interés de los ciudadanos de la Ciudad de Sanford que la Comisión Municipal proponga enmiendas a la Carta de la Ciudad de Sanford en una elección de referéndum de acuerdo con la Carta de la Ciudad de Sanford y la Sección 166.031, Estatutos de la Florida, y de la forma establecida en este documento; y

 

Considerando que, las palabras con tipo subrayado constituirán adiciones al texto original y el tachado constituirá tachaduras al texto original.

 

Por lo Tanto, sea Aprobado Por la Gente de la Ciudad de Sanford, Florida, de la siguiente manera:

 

Sección 1. Revisión Propuesta de la Sección 2.01, Sección 6.01 y la Sección 6.07 de la Carta de la Ciudad; Redistribución de Distritos. Se propone enmendar la Sección 2.01, la Sección 6.01 y la Sección 6.07 de la Carta de la Ciudad de Sanford, Florida, para que se lea como sigue:

 

Sección 2.01. - Composición, términos y elegibilidad.

(a) Comisión Municipal. El cuerpo gobernante local de la Ciudad será: Que por la presente se crea una Comisión Municipal de la Ciudad de Sanford, Florida, que constará de cinco (5) miembros; cuatro (4) comisionados y compuesto por un Alcalde, a quien también se le conocerá como un Comisionado, y ya sean cuatro (4) o seis (6) Comisionados de la Ciudad en número, según lo determine la ordenanza promulgada por la Comisión Municipal,  todos cada uno de los cuales serán elegidos por un término de cuatro (4) años, comenzando y terminando el cuarto lunes de enero. Los Comisionados de la Ciudad continuarán en su presente cargo hasta que expire su actual periodo de mandato y hasta que sus sucesores sean elegidos y tomen posesión del cargo, a menos que ocurran vacantes en el mismo.

(b) Elegibilidad. Solo los votantes calificados de la Ciudad serán elegibles para ocupar el cargo de Comisionado. Ninguna persona se postulará para más de un puesto en la Comisión en una elección y ninguna persona se postulará para Alcalde y un puestp en la Comisión en la misma elección.

 

Sección 6.01. - Elección de alcalde y comisionados; fechas de elecciones regulares y de segunda vuelta electoral.

(a) Las elecciones municipales regulares de la Ciudad se realizarán simultáneamente con las elecciones primarias Estatales de cada año electoral y las elecciones de segunda vuelta electoral, de ser necesario, se realizarán simultáneamente con las elecciones generales del Estado, de cada año electoral, después de que se complete la calificación y después de consultar con el Supervisor de Elecciones del Condado de Seminole.

(b) Puestos de la Comisión Municipal son por la presente designados como Alcalde y los puestos restantes para los distritos de la Comisión Municipal 1, 2, 3 y 4. Los candidatos para los cargos de Alcalde y Comisionado de la Ciudad presentarán una solicitud para calificar para la Alcaldía o el distrito de la Comisión Municipal, según lo dispuesto por la ley.

(c) Cada candidato para el cargo debe anunciar si él o ella es un candidato al cargo de Alcalde o para un distrito de la Comisión Municipal. Cuando se elija a más de un (1) Comisionado, los candidatos a Comisionado se agruparán por número de distrito y cada candidato deberá anunciar el distrito por el cual el/ella es candidato.

(d) El candidato a Alcalde que reciba la mayoría de los votos para el cargo de Alcalde, será elegido. El candidato en cada distrito para Comisionado que reciba la mayoría de los votos en ese distrito, será elegido. En caso de que ningún candidato al cargo de Alcalde reciba la mayoría de los votos para el cargo de Alcalde en la elección municipal regular de la Ciudad, celebrada simultáneamente con las elecciones primarias del Estado, se realizará una segunda vuelta electoral, según lo dispuesto en subsección (a), en cual dicha elección de segunda vuelta, solo los dos (2) candidatos para Alcalde que reciban la mayoría de votos en las elecciones municipales regulares, serán candidatos, y el candidato para Alcalde que reciba la mayoría de los votos por el cargo de Alcalde, será elegido. En caso de que ningún candidato a Comisionado en un distrito reciba la mayoría de los votos en ese distrito en las elecciones municipales regulares celebradas simultáneamente con las elecciones primarias del Estado, se realizará una segunda vuelta electoral, según lo dispuesto en subsección (a), en cual dicha elección de segunda vuelta solo los dos (2) candidatos a Comisionado que reciban la mayoría de los votos en las elecciones municipales regulares para ese distrito, serán candidatos, y el candidato para Comisionado que reciba la mayoría de los votos para Comisionado en un distrito, será elegido.

(e) Los votos por escrito se permitirán y se contarán de acuerdo con la ley Estatal dominante. Los nombres de los candidatos sin oposición no aparecerán en la papeleta cuando no esté de acuerdo con la ley Estatal dominante.

(f) Cualquier asunto que por los términos de esta Carta pueda ser presentado a los electores de la Ciudad en cualquier elección especial, puede ser presentado y sometido a voto en cualquier elección de la Ciudad, según lo dispuesto en esta sección.

 

Sección 6.07. - Distritos de la Comisión Municipal y Redistribución de Distritos.

 

(a) No obstante cualquier otra disposición de esta Carta, el Alcalde representará a la Ciudad entera y será elegido por los electores en toda la Ciudad. Cada Comisionado de la Ciudad representará un solo distrito de la Comisión Municipal ,residirá físicamente en el distrito para el cual busca el cargo, desde la fecha de calificación para el cargo, hasta la expiración del periodo del cargo por el cual fue elegido y será elegido únicamente por los votantes de ese distrito.

(b) Habrá un número de cuatro (4) distritos de la Comisión Municipal , ya sea cuatro (4) o seis (6) en numero, según lo determinado por la ordenanza promulgada por la Comisión Municipal , que serán establecidas áreas de la Ciudad, definidas y descritas geográficamente, tal como se define por Ordenanza Número 4032 y su subsecuentes ordenanzas sucesoras relacionadas con la redistribución de distritos de la Comisión Municipal, según lo requiere esta Carta, la ley general y los principios constitucionales. Cada distrito se formará a partir de un territorio contiguo compacto con las líneas fronterizas siguiendo los centros de las calles, hasta donde sea practico. Se debe dar merecida consideración a mantener la integridad geográfica de los vecindarios y urbanizaciones dentro de los distritos individuales. Las líneas de distrito de la Comisión Municipal se construirán de manera que cumplan con los principios constitucionales de representación igual y efectiva requeridos por las pautas Estatales y Federales aplicables. La Comisión Municipal prestará debida consideración a los múltiples principios constitucionales involucrados en el proceso electoral y prestará la debida consideración a la oportunidad de representación minoritaria en la Comisión Municipal, como parte del proceso de redistribución de distritos, en cumplimiento con los estándares constitucionales Estatales y Federales aplicables.

(c) El número de puesto de un Comisionado titular puede cambiar debido al proceso de realineación que se produce durante la redistribución de distritos. Sin embargo, ningún Comisionado titular tendrá un periodo de mandato interrumpido por la adopción de un plan de redistribución de distritos.

(d) La Comisión Municipal puede modificar los distritos de la Comisión Municipal mediante la promulgación de una ordenanza sucesora conforme a dichos procesos, procedimientos y comités de redistribución de distritos y / o consultores que la Comisión Municipal pueda considerar deseables. La Comisión Municipal comenzará el inicio de un proceso de redistribución de distritos para los distritos de la Comisión Municipal , dentro de treinta (30) días después de recibir los datos oficiales del Censo Decenal cada diez (10) años, para finalizar el proceso de redistribución ciento cincuenta (150) días antes de la primera fecha para calificar para la próxima elección regular de la Ciudad. En caso de que el proceso de redistribución de distritos no se complete antes de dicho período anticipado de ciento cincuenta (150) días, a partir de entonces la Comisión Municipal deberá llevar a cabo el proceso de redistribución de distritos tan pronto como sea razonablemente posible. Los datos oficiales del Censo Decenal serán la fuente autorizada de los datos demográficos utilizados para reconstituir los distritos de la Comisión Municipal , en conformidad con los estándares Estatales y Federales aplicables.

 

Sección 2. Pregunta Numero Uno de la Papeleta. La forma de la papeleta para la enmienda de la Carta provista en la Sección 1 de esta Ordenanza, será la siguiente:

 

1 Ver, Sección 101.161, Estatutos de la Florida, en relación con el referéndum y las papeletas relacionadas con los mismos. La disposición legal establece lo siguiente:

 

101.161 Referéndum; papeletas.-

(1) Siempre que una enmienda constitucional u otra medida pública se someta al voto del pueblo, el resumen de la votación de dicha enmienda u otra medida pública se imprimirá en un lenguaje claro e inequívoco en la papeleta después de la lista de candidatos, seguido del la palabra "sí" y también la palabra "no", y se diseñará de manera que un voto "sí" indique la aprobaciónde la propuesta y un voto "no" indique el rechazo. El resumen de la papeleta de la enmienda u otra medida pública y el título de la papeleta que aparecerá en la papeleta se incluirá en la propuesta de comisión de revisión constitucional, propuesta de convención constitucional, propuesta de comisión de reforma tributaria y presupuestaria o resolución u ordenanza habilitadora. El resumen de la papeleta de la enmienda u otra medida pública debe ser una declaración explicativa, que no exceda 75 palabras, del propósito principal de la medida. Además, para cada enmienda propuesta por iniciativa, la papeleta incluirá, siguiendo el resumen de la papeleta, una declaración de impacto financiero por separado con respecto a la medida preparada por la Conferencia de Estimación del Impacto Financiero de acuerdo con s. 100.371 (5). El título de la votación consistirá en un subtítulo, que no excederá 15 palabras, por el cual se hace referencia o se habla comúnmente de la medida. Esta subsección no se aplica a las enmiendas constitucionales o revisiones propuestas por resolución conjunta.

(2) El patrocinador debe preparar el resumen de la papeleta y el título de la papeleta de una enmienda constitucional propuesta por iniciativa, y debe ser aprobado por el Secretario de Estado de acuerdo con las reglas adoptadas de conformidad con s.120.54. El Departamento de Estado le dará a cada enmienda constitucional propuesta un número designado para una referencia conveniente. Esta designación de número aparecerá en la papeleta. Los números de designación se asignarán en el orden de presentación o certificación y de acuerdo con las reglas adoptadas por el Departamento de Estado. El Departamento de Estado deberá proporcionar el número de designación, el título de la votación y, a menos que se especifique lo contrario en una resolución conjunta, el resumen de la papeleta de cada enmienda, al supervisor de elecciones de cada condado en el que se votará dicha enmienda.

(3) (a) Cada resolución conjunta que propone una enmienda o revisión constitucional incluirá uno o más enunciados de votación establecidos por orden de prioridad. Cada declaración de la votación consistirá en un título de la papeleta, por el cual se hace referencia a la medida o se habla de ella, sin exceder 15 palabras, y un resumen de la votación que describa el propósito principal de la enmienda o revisión, en un lenguaje claro e inequívoco. Si una resolución conjunta que propone una enmienda o revisión constitucional contiene solo una declaración de votación, el resumen de la votación no puede exceder 75 palabras. Si una resolución conjunta que propone una enmienda o revisión constitucional contiene más de una declaración de la votación, el primer resumen de la votación, en orden de prioridad, no puede exceder 75 palabras.

(b) El Departamento de Estado deberá proporcionar un número de designación de conformidad con la subsección (2) y la declaración de la papeleta correspondiente, al supervisor de elecciones de cada condado. La declaración de la votación se imprimirá en la papeleta después de la lista de candidatos, seguida de la palabra "sí" y también de la palabra "no", y se diseñará de manera tal que un voto "sí" indicará la aprobación de la enmienda o revisión y un voto "no" indicará rechazo.

(c) 1. Cualquier acción para una determinación judicial en la cual o más declaraciones contenidas en una resolución conjunta son defectuosas, debe iniciarse mediante la presentación de una queja o petición ante el tribunal correspondiente dentro de los 30 días posteriores a la presentación de la resolución conjunta ante el Secretario de Estado. La queja o petición deberá hacer valer todos los motivos de la impugnación de cada enunciado. Cualquier motivo no formulado dentro de los 30 días posteriores a la presentación de la resolución conjunta ante el Secretario de Estado no se aplica.

2. El tribunal, incluido cualquier tribunal de apelación, otorgará prioridad a una acción descrita en el subpárrafo 1. sobre otros casos pendientes y emitirá una decisión lo más rápidamente posible. Si el tribunal determina que todas las declaraciones contenidas en una resolución conjunta son defectuosas y se rechazan, abandonan o agotan otras apelaciones, a menos que se disponga lo contrario en la resolución conjunta, el Fiscal General deberá, dentro de los 10 días, preparar y presentar al Departamento de Estado, un título revisado de la papeleta o un resumen de la papeleta que corrija las deficiencias identificadas por el tribunal, y el Departamento de Estado deberá proporcionar un número de designación y el título de la papeleta revisada o el resumen de la papeleta al supervisor electoral de cada condado para su inclusión en la papeleta. El resumen revisado de la papeleta puede exceder 75 palabras. El tribunal retendrá jurisdicción sobre las impugnaciones de un título revisado, o resumen de la papeleta, preparado por el Fiscal General, y cualquier impugnación de un título de papeleta revisado, o resumen de la papeleta, debe presentarse dentro de los 10 días posteriores a la presentación de un título de papeleta, o resumen de papeleta, al Departamento de Estado.

(4) (a) Para cualquier elección general en la que el Secretario de Estado, para cualquier circuito, o el supervisor de elecciones, para cualquier condado, haya certificado el puesto de votación para una iniciativa para cambiar el método

 

Redistribución de distritos; Número de Comisionados.

Sección 3. Revisión Propuesta de la Sección 6.01, Sección 6.02, Sección 6.03, Sección 6.05 Y Sección 6.06, Carta de la Ciudad; Elecciones. Se propone enmendar el Artículo VI, Sección 6.01, Sección 6.02, Sección 6.03, Sección 6.05 y Sección 6.06 de la Carta de la Ciudad de Sanford, Florida, para que se lea como sigue:

 

ARTÍCULO VI. – ELECCIONES

 

de la selección de jueces, la papeleta de cualquier circuito debe contener la declaración en el párrafo (b) o el párrafo (c) y la papeleta para cualquier condado debe contener la declaración en el párrafo (d) o el párrafo (e).

(b) En cualquier circuito donde la iniciativa cambie la selección de jueces de tribunales de circuito a selección por selección y retención por méritos, la papeleta deberá indicar: "Deberá el método de seleccionar jueces de tribunales de circuito en el circuito judicial (número del circuito) cambiar de la elección por el voto del pueblo a la selección por la comisión de nominación judicial y el nombramiento por el Gobernador con los periodos de servicio subsiguientes determinados por un voto de retención del pueblo? "Esta declaración debe ir seguida de la palabra" sí "y también por la palabra "no"

(e) En cualquier condado donde la iniciativa cambie la selección de jueces de tribunales de condado para elección de los votantes, la papeleta deberá indicar: "¿Deberá cambiarse el método de selección de los jueces de los tribunales de condado en (nombre del condado) de la selección por la comisión de nominación judicial y el nombramiento por el Gobernador con los términos subsiguientes determinados por un voto de retención del pueblo a la elección por el voto del pueblo? "Esta declaración debe ser seguida por la palabra" sí "y también por la palabra" no.

 

Sección 6.01. - Elección de alcalde y comisionados; fechas de elecciones regulares y de segunda vuelta.

(a) Las elecciones municipales regulares de la Ciudad se realizarán simultáneamente con las elecciones primarias Estatales de cada año electoral y las elecciones de segunda vuelta, de ser necesarias, se realizarán simultáneamente con las elecciones generales del Estado de cada año electoral, después de que se complete la calificación y después de la consulta con el Supervisor de Elecciones del Condado de Seminole.

(b) Los puestos de la Comisión Municipal se designan como el de Alcalde y los puestos para los distritos 1, 2, 3 y 4 de la Comisión Municipal . Los candidatos para los cargos del Alcalde y Comisionado de la Ciudad, presentarán una solicitud para calificar para el cargo de Alcalde o un distrito de la Comisión Municipal , según lo dispuesto por la ley.

(c) Cada candidato para un cargo debe anunciar si él o ella es un candidato para el cargo de Alcalde o para un distrito de la Comisión Municipal . Cuando se elija a más de un (1) Comisionado, los candidatos a Comisionado se agruparán por número de distrito y cada candidato deberá anunciar el distrito para el que es candidato.

(d) El candidato a Alcalde que reciba la mayoría de los votos para el cargo de Alcalde, será elegido. El candidato en cada distrito para el cargo de Comisionado que reciba la mayoría de los votos en ese distrito, será elegido. En caso de que ningún candidato al cargo de Alcalde reciba la mayoría de los votos para el cargo de Alcalde en la elección municipal regular de la Ciudad, la cual es celebrada simultáneamente con las elecciones primarias del Estado, se realizará una segunda vuelta electoral, según lo dispuesto en subsección (a), en cual elección de segunda vuelta solo los dos (2) candidatos al cargo de Alcalde que reciban la mayoría de votos en la elección municipal regular, serán candidatos, y el candidato al cargo de Alcalde que reciba la mayoría de votos para el cargo de Alcalde, será elegido; provisto, sin embargo, que, si hay un empate para el candidato que recibe el segundo voto más alto para Alcalde, el empate se resolverá en la primera fecha disponible después de la elección, según lo determine el Secretario  Municipal , tirando una moneda al aire. En caso de que ningún candidato a Comisionado en un distrito reciba la mayoría de los votos en ese distrito en las elecciones municipales regulares, celebradas simultáneamente con las elecciones primarias del Estado, se realizará una segunda vuelta según lo dispuesto en subsección (a), en cual elección de segunda vuelta solo los dos (2) candidatos para el cargo de Comisionado que reciban la mayoría de votos en las elecciones municipales regulares para ese distrito, serán candidatos, y el candidato para Comisionado que reciba la mayoría de los votos por el cargo de Comisionado en un distrito, será elegido; provisto, sin embargo, que, si hay un empate para el candidato que reciba la segunda cantidad de votos mas alta para el cargo de Alcalde, el empate se resolverá en la primera fecha disponible después de la elección, según lo determine el Secretario  Municipal , tirando una moneda al aire.

(e) Los votos por escrito se permitirán y se contarán de acuerdo con la ley Estatal dominante. Los nombres de los candidatos sin oposición no aparecerán en la papeleta cuando no estén de acuerdo con la ley Estatal dominante.

(f) Cualquier asunto que, por los términos de esta Carta pueda ser presentado a los electores de la Ciudad, en cualquier elección especial, puede ser presentado y sometido a voto en cualquier elección de la Ciudad, según lo dispuesto en esta sección.

 

Sección 6.02. – Misma - Calificación de candidatos; forma del juramento.

 

(a) Cualquier persona que sea un elector calificado en la Ciudad de Sanford, no un delincuente condenado de un delito mayor, cuyos derechos civiles no han sido restaurados y que esté de otra manera calificado, puede convertirse en candidato para el cargo de Alcalde o Comisionado de la Ciudad al someter una notificación por escrito con el Secretario Municipal, de su intención de convertirse en candidato de conformidad con el Artículo II y esta Sección, solicitando que su nombre se imprima en la papeleta y deposite con dicha notificación escrita una suma igual al cinco por ciento (5%) de el salario anual efectivo del cargo que busca el candidato, más los costos de cualquier tarifa electoral aplicable por mandato estatal, como una tarifa que califica para el cargo solicitado. Todas las tarifas de calificación del 5% se colocarán en el fondo general de la Ciudad de Sanford y se destinarán al costo de las elecciones Municipales. Las tarifas de las elecciones Estatales se transferirán al estado de Florida según lo dispuesto por la ley general del Estado.

(b) El período dentro del cual un candidato puede calificar como arriba mencionado comenzará noventa y dos (92) días antes de la elección y terminará a las 12:00 del mediodía del último quinto día regular de trabajo para la oficina del Secretario Municipal ochenta y ocho (88) días antes de la fecha de la elección. La calificación solo se puede realizar durante el horario normal de trabajo para la oficina del  Secretario  Municipal . A las personas que estén en línea al finalizar el período de calificación se les permitirá presentar sus documentos que estén disponibles en ese momento en un intento de calificar.

(c) Cualquier persona que sea un elector calificado en la Ciudad de Sanford, y de otra manera calificado, puede alternativamente convertirse en un candidato para el cargo de Alcalde o Comisionado Municipal, al registrar con el Secretario  Municipal un aviso por escrito, de su intención de convertirse en candidato de acuerdo con el Artículo II y esta Sección, solicitando que su nombre se imprima en la papeleta y presentando una petición escrita con los nombres de doscientos cincuenta (250) firmantes que son electores elegibles que residen en el distrito de la Comisión que el candidato solicita. Los candidatos para Alcalde que califican por petición deberán presentar una petición escrita con los nombres de quinientos (500) firmantes que son votantes elegibles que residen dentro de la Ciudad. La forma de la petición debe cumplir con la ley de la Florida. Las peticiones para colocar el nombre de un candidato en la papeleta pueden enviarse a la Secretario  Municipal para su verificación total o parcial. Los candidatos que califican por petición pueden comenzar a recopilar y entregar los nombres en las peticiones ciento veinte (120) días antes de la apertura del período de calificación. Todas las peticiones para colocar el nombre de un candidato en la papeleta electoral deben ser recibidas por la oficina del Secretario Municipal antes del final del período de calificación. La oficina del Secretario Municipal deberá presentar los nombres en las peticiones de calificaciones escritas al supervisor de la oficina electoral para la certificación como elector válido y deberá notificar oportunamente el número de electores certificados al candidato hasta que se cumpla el número requerido de electores o el período de calificación finalizó y el candidato no pudo cumplir con los números requeridos de electores certificados durante su intento de petición de calificación.

(d) Los costos, según lo requerido por la ley Estatal, de las certificaciones de elector serán pagados a la oficina del Secretario Municipal por los candidatos individuales que soliciten la certificación como parte de los procedimientos de calificación.

(e) La oficina del Secretario Municipal verificará la residencia de los candidatos para el cargo de Alcalde y los puestos del distrito de la Comisión Municipal . Los candidatos deberán residir en el distrito para el cual buscan calificar y firmarán una declaración jurada de residencia y deberán proporcionar documentos adecuados que establezcan su residencia, como parte del proceso de calificación. Los documentos que serán suficientes para servir como prueba autorizada de residencia incluyen, entre otros, licencias de conducir, documentos de exención de vivienda, pasaportes, tarjetas de identificación de elector, otras tarjetas de identificación gubernamentales y facturas de servicios públicos. Los Comisionados elegidos para la Comisión residirán físicamente en el distrito en el que fueron elegidos para representar o residir en el distrito que buscan representar.

(f) Se entiende que pueden surgir circunstancias urgentes y de emergencia de vez en cuando.

(g) Si una circunstancia apremiante causa que el lugar físico de residencia de un Comisionado sea inhabitable o destruido y se vea obligado a residir temporalmente en otro lugar dentro de la Ciudad, entonces y en ese caso:

(1) El Comisionado / candidato deberá hacer esfuerzos razonables para reubicarse dentro de su distrito electivo.

(2) A falta de tal esfuerzo, el Comisionado / candidato debe buscar la aprobación de la Comisión Municipal , para residir temporalmente fuera de su distrito elegido.

(3) La autoridad de la Comisión para que un Comisionado / candidato resida fuera del distrito, se otorgará por un período razonable ya que existe un requerimiento de reubicación temporal exigente y válido según lo determine la Comisión.

(4) Las solicitudes de prórroga serán escuchadas y atendidas por la Comisión, dándole atención a todas las circunstancias exigentes.

(h) Cualquier persona que sea residente de la Ciudad y haya calificado como elector en la misma, puede convertirse en candidato para el cargo de Alcalde o Comisionado, calificando según lo descrito anteriormente y tomando y suscribiendo a un juramento o afirmación sustancialmente en la forma requerida por las leyes generales de Florida.

 

Sección 6.03. - Nombres que se colocarán en la papeleta para la elección regular.

Los nombres de todos los candidatos para el cargo de alcalde se colocarán en la papeleta electoral primero y en orden alfabético.

Los nombres de todos los candidatos para puestos de comisión se colocarán en la papeleta de las elecciones regulares en orden alfabético para que se vote sobre el puesto de la comisión. Los puestos de la Comisión se enumerarán en la papeleta en su orden numérico.

Las papeletas electorales de segunda vuelta deberán estar en la misma forma que se prescribe aquí para la papeleta de elección municipal regular.

 

Sección 6.05. - Voto en ausencia.

El voto en ausencia se permitirá en las elecciones municipales de la misma manera que se puede proporcionar en las elecciones estatales.

 

Sección 6.06. - Calificación de electores; método de prescripción y forma de elección.

A ninguna persona se le permitirá votar en ninguna elección con el propósito de elegir a los Comisionados de la Ciudad y al Alcalde para dicha ciudad, que no sea un votante calificado bajo la ley Estatal. La Comisión Municipal , por ordenanza, prescribirá el método y la manera de celebrar todas las elecciones que se convocarán y celebrarán y que no están previstas en los términos de esta Carta. Todas las tales elecciones Municipales se llevarán a cabo sustancialmente sobre el principio adoptado para las elecciones Estatales en la medida en que no haya conflicto con los términos de esta

carta; siempre que la Comisión Municipal pueda, por ordenanza, prescribir el método, la manera y la conducta de todas las elecciones de dicha ciudad que no entren en conflicto con esta carta. La oficina del Secretario  Municipal, con la aprobación del Administrador de la Ciudad, adoptará reglas y procedimientos relacionadas con la administración e implementación de las elecciones municipales y todas las disposiciones del Código de la Ciudad en la fecha de vigencia de esta enmienda serán dirigidas por el Administrador de la Ciudad y pueden ser administrativamente derogadas y eliminadas del Código de la Ciudad y la oficina del Secretario  Municipal puede adoptar reglas para reemplazar dichas disposiciones del Código de la Ciudad. Todas las reglas a ser adoptadas por la oficina del Secretario Municipal serán presentadas a la Comisión Municipal para su aprobación antes de que las reglas entren en vigencia.

 

Sección 4. Pregunta Numero Dos en la Papeleta. La forma de la papeleta para la enmienda de la Carta provista en la Sección 3 de esta Ordenanza será la siguiente:

 

Elecciones de la ciudad; Controles de Leyes Estatales; Empate de Votos; Calificación Para Cargos.

 

Se propone una enmienda para enmendar la Carta de la Ciudad de Sanford para conformar las elecciones municipales a la ley Estatal y abordar el empate de votos, los tiempos de calificación para el cargo y la adopción de reglas.

Sección 5. Revisión propuesta de la Sección 2.01 y Sección 6.04, Carta de la Ciudad; Fecha de Toma de Cargo. Se propone enmendar la Sección 2.01 y la Sección 6.04 de la Carta de la Ciudad de Sanford, Florida, para que se lea como sigue:

 

Sección 2.01. - Composición, periodos y elegibilidad.

(a) Comisión Municipal . Que por la presente se crea una Comisión Municipal de la Ciudad de Sanford, Florida, que constará de cinco (5) miembros; cuatro (4) comisionados y un alcalde, quien también será conocido como un comisionado, cada uno de los cuales será elegido por un período de cuatro (4) años, comenzando y terminando el segundo cuarto lunes en diciembre enero. Los comisionados de la ciudad continuarán en su cargo hasta que expire su actual mandato y hasta que sus sucesores sean elegidos y tomen posesión del cargo, a menos que ocurran vacantes en el mismo. (b) Elegibilidad. Solo votantes calificados de la Ciudad serán elegibles para ocupar el cargo de comisionado. Ninguna persona se postulará para más de un puesto en la comisión en una elección y ninguna persona se postulará para alcalde y un puesto en la comisión en la misma elección.

 

Sección 6.04. - Comisión para declarar  a la persona elegida / comienzo del mandato.

 

Todos los candidatos elegidos como Alcalde o como Comisionado de la Ciudad por elección regular o de segunda vuelta, según lo dispuesto en la Sección 6.0, tomarán posesión del cargo el segundo cuarto lunes en diciembre enero inmediatamente posterior a la elección ordinaria o de segunda vuelta en las que candidatos exitosos se determinan. Todos los candidatos elegidos por elección especial tomarán posesión después de la certificación de los resultados de las elecciones por parte de la Comisión.

 

Transición.

Los Comisionados de la Ciudad con sus puestos vigentes en la fecha de entrada en vigencia de esta enmienda de la Carta continuarán cumpliendo sus mandatos actuales. Los Comisionados de la Ciudad elegidos en 2020 tendrán términos de mandato que terminen de acuerdo con esta enmienda de la Carta.

 

Sección 6. Pregunta Número Tres en la Papeleta. La forma de la papeleta para la enmienda de la Carta, provista en la Sección 5 de esta Ordenanza, será la siguiente:

Sección 7. Propuesta de Revisión de la Sección 2.02, Carta de la Ciudad; Compensación / Gastos. Se propone enmendar la Sección 2.02 de la Carta de la Ciudad de Sanford, Florida, para que se lea como sigue:

 

Sección 2.02. - Compensación gastos.

El comisión puede determinar el salario anual del Alcalde y los Comisionados de la Ciudad recibirán por sus servicios una compensación anual razonable que será el salario autorizado por la Sección 145.031 de los Estatutos de la Florida, o su disposición sucesora; provisto, sin embargo, que el cálculo será para el Grupo de población III base multiplicada por 56.7 por ciento para el Alcalde y multiplicada por 46.7 por cientos, para los Comisionados de la Ciudad, y ajustes futuros, pero sin ningún ajuste basado en los aumentos de sueldo de los empleados Estatales aprobados por la Legislatura de Florida. por ordenanza, pero ninguna ordenanza que aumente dicho salario entrará en vigor hasta la fecha de inicio de los términos de los comisionados elegidos en la próxima elección regular. El Alcalde y los Comisionados de la Ciudad recibirán sus gastos en el desempeño de sus funciones de acuerdo con la Sección 112.061 de los Estatutos de la Florida, relacionados con las dietas y los gastos de viaje de los funcionarios públicos, empleados o sus disposiciones sucesoras, o la política de la Ciudad relativa a viajes pertenecientes a empleados municipales, que prevalecerán en caso de conflicto. La fórmula establecida aquí es la siguiente: Salario base (según lo determinado por el cuadro de tarifas del grupo poblacional) + (Población actual de la ciudad - Mínimo del grupo poblacional del cuadro de índice del grupo poblacional) x Tasa grupal del cuadro de tasas del grupo poblacional x Factor Inicial (referenciado en la Sección 145.19 (2) (c), Estatutos de la Florida) x Factor Anual Certificado (Determinado por el estado anualmente y referenciado en la Sección 145.19, Estatutos de la Florida) x Factor Anual Acumulado Certificado (Determinado por el estado anualmente y referenciado en la Sección 145.19 , Estatutos de la Florida) x 46.7 para un Comisionado o x 56.7 para el Alcalde.

 

NOTA: Las disposiciones legales referenciadas dicen lo siguiente:

 

145.031 Junta de comisionados del condado.-

(1) Cada miembro de la junta de comisionados del condado recibirá como salario la cantidad indicada, basado en la población de su condado. Además, se deberá compensar los incrementos de población por encima del mínimo para cada grupo de población, que se determinará multiplicando la población en exceso del mínimo para la agrupación multiplicada por la tasa de grupo.

(2) Ningún miembro de un cuerpo directivo de un condado fletado o un condado con una forma consolidada de gobierno se considerará como el equivalente de un comisionado del condado a los efectos de determinar la compensación de dicho miembro conforme a su carta respectiva.

(3) No obstante las disposiciones de esta sección o s. 145.19, cada miembro de la junta de comisionados del condado puede reducir su tasa salarial de forma voluntaria.

 

145.19 Incrementos porcentuales anuales basados en el aumento para los empleados del servicio de carrera estatal; limitación.-

(1) Tal como se utiliza en esta sección, el término:

(a) "Factor anual" significa 1 más el menor de:

1. El aumento porcentual promedio en los salarios de los empleados de servicios de carrera del estado para el año fiscal en curso según lo determinado por el Departamento de Servicios de Administración o según lo dispuesto en la Ley de Apropiaciones Generales; o

2. Siete por ciento.

(b) "Factor anual acumulado" significa el producto de todos los factores anuales certificados bajo esta ley antes del año fiscal para el cual se calculan los salarios.

(c) "Factor inicial" significa un factor de 1.292, que es un producto, redondeado a la milésima más cercana, de un factor anterior de aumento del costo de la vida autorizado por el capítulo 73-173, Leyes de Florida, y previsto por la Legislatura para preservar en ajustes a los salarios hechos antes de la promulgación del capítulo 76-80, Leyes de Florida, multiplicado por el factor de aumento anual autorizado por el capítulo 79-327, Leyes de Florida.

(2) Cada año fiscal, los sueldos de todos los funcionarios enumerados en este capítulo, s. 1001.395, y s. 1001.47 se ajustará. La tasa salarial ajustada será el producto, redondeado al dólar más cercano, de la tasa salarial otorgada por la sección correspondiente de este capítulo, s. 1001.395, o s. 1001.47 multiplicado primero por el factor inicial, luego por el factor anual acumulado, y finalmente por el factor anual. El Departamento de Servicios de Administración certificará el factor anual y los factores anuales acumulados. Cualquier salario de calificación especial recibido bajo este capítulo, s. 1001.47, o el incentivo salarial de rendimiento anual disponible para los superintendentes elegidos bajo s. 1001.47 se agregará a dicha tasa salarial ajustada. El salario de calificación especial será de $ 2,000, pero no excederá $ 2,000.

 

112.061 Per diem y gastos de viaje de funcionarios públicos, empleados y personas autorizadas.-

 

(1) INTENCIÓN LEGISLATIVA. Para evitar desigualdades, conflictos, inconsistencias y fallas en las numerosas leyes que regulan o intentan regular los gastos de viaje de los funcionarios públicos, empleados y personas autorizadas en el estado, es la intención de la Legislatura:

(a) Establecer tarifas, procedimientos y limitaciones estándar de reembolso de viajes, con ciertas excepciones y exenciones justificables, aplicables a todos los funcionarios públicos, empleados y personas autorizadas cuyo viaje esté autorizado y pagado por una agencia pública.

(b) Para preservar la estandarización establecida por esta ley:

1. Las disposiciones de esta sección prevalecerán sobre cualquier disposición conflictiva en una ley general, presente o futura, en la medida del conflicto; pero si una de tales leyes generales contiene una exención específica de esta sección, incluida una referencia específica a esta sección, dicha ley general prevalecerá, pero solo en la medida de la exención.

2. Las disposiciones de cualquier ley especial o local, presente o futura, prevalecerán sobre cualquier disposición conflictiva en esta sección, pero solo en la medida del conflicto.

(2) DEFINICIONES.- A los fines de esta sección, las siguientes palabras tendrán los significados indicados:

(a) Agencia o agencia pública: cualquier oficina, departamento, agencia, división, subdivisión, subdivisión política, junta, oficina, comisión, autoridad, distrito, organismo público, cuerpo político, condado, ciudad, poblado, pueblo, municipio o cualquier otra unidad de gobierno separada creada de conformidad con la ley.

(b) De la agencia jefe o jefe de la agencia: La autoridad de formulación de políticas más alta de una agencia pública, como se define en este documento.

(c) Funcionario u oficial público: un individuo que en el cumplimiento de sus deberes oficiales está investido por ley con poderes soberanos de gobierno y que es elegido por el pueblo o comisionado por el Gobernador y tiene jurisdicción que se extiende a través de todo el estado, o cualquier persona que sirva legalmente en lugar de cualquiera de las dos clases anteriores de individuos como designado inicial o sucesor.

(d) Empleado o empleado público: un individuo, ya sea comisionado o no, que no sea un funcionario o persona autorizada como se define en este documento, que ocupa un puesto regular o de tiempo completo autorizado y es responsable ante un jefe de agencia.

(e) Persona autorizada-

1. Una persona que no sea un funcionario público o empleado como se define en este documento, ya sea elegido o comisionado o no, que está autorizado por el jefe de una agencia para incurrir en gastos de viaje en el desempeño de sus funciones oficiales.

2. Una persona que es llamada por una agencia para contribuir tiempo y servicios como consultor o asesor.

3. Una persona que es candidata para un puesto ejecutivo o profesional.

(f) Viajero: un funcionario público, empleado público o persona autorizada cuando realiza un viaje autorizado.

(g) Gasto de viaje, gastos de viaje, gastos necesarios durante el viaje, gastos reales durante el viaje o palabras de índole similar: gastos comunes e incidentales habituales incurridos necesariamente por un viajero.

(h) Aerolínea común - Tren, autobús, líneas aéreas comerciales que operan vuelos regulares o automóviles de alquiler de una empresa establecida de alquiler de automóviles.

(i) Día de viaje - Un período de 24 horas que consta de cuatro trimestres de 6 horas cada uno.

(j) Período de viaje - Un período de tiempo entre la hora de salida y la hora de regreso.

(k) Viaje de Clase A - Viaje continuo de 24 horas o más fuera de la sede oficial.

(l) Viajes Clase B - Viajes continuos de menos de 24 horas que incluye estancias nocturnas de la sede oficial.

(m) Viajes clase C - Viajes cortos o de un día en los que el viajero no tiene estancias nocturnas de la sede oficial.

(n) Viajes al extranjero - Viajes fuera de los Estados Unidos.

(3) AUTORIDAD PARA INCURRIR EN GASTOS DE VIAJE.-

(a) Todos los viajes deben ser autorizados y aprobados por el jefe de la agencia, o su representante designado, de cuyos fondos se paga al viajero. El director de la agencia no autorizará ni aprobará dicha solicitud, a menos que vaya acompañada de una declaración firmada por el supervisor del viajero en la que se establezca que dicho viaje es un asunto oficial del estado y también que indique el propósito de dicho viaje.

(b) Los gastos de viaje de los viajeros se limitarán a aquellos gastos en los que necesariamente incurran en el desempeño de un propósito público autorizado por la ley y que se lleven a cabo dentro de las limitaciones prescritas por esta sección.

(c) Viajes de funcionarios públicos o empleados que sirven temporalmente en nombre de otra agencia o en parte en nombre de más de una agencia al mismo tiempo, o personas autorizadas a quienes se les pide que contribuyan con tiempo y servicios como consultores o asesores, pueden ser autorizadas por el jefe de la agencia. La explicación completa y la justificación deben figurar en el comprobante de gastos de viaje o adjuntada al mismo.

(d) Los gastos de viaje de los empleados públicos con el único propósito de tomar el sistema de mérito u otros exámenes de colocación laboral, escritos u orales, no se permitirán bajo ninguna circunstancia, excepto que con previa aprobación por escrito del jefe de la agencia o la persona designada por él o ella, los candidatos para puestos ejecutivos o profesionales pueden recibir los gastos de viaje en conformidad con esta sección.

(e) Gastos de viaje de funcionarios o empleados públicos con el fin de implementar, organizar, dirigir, coordinar o administrar o apoyar la implementación, organización, dirección, coordinación o administración de actividades relacionadas o que impliquen viajes a un estado terrorista no se permitirán bajo ninguna circunstancia. Para los propósitos de esta sección, "estado terrorista" se define como cualquier estado, país o nación, designado por el Departamento de Estado de los Estados Unidos como un estado patrocinador del terrorismo.

(f) El jefe de la agencia, o un representante designado, puede pagar por adelanto o reembolso, o una combinación de los mismos, los costos per diem de los viajeros, por viajes al extranjero, según las tasas actuales, según lo especificado en la publicación federal "Normas Estandarizadas (Empleados Gubernamentales Civiles, Áreas Extranjeras) "y gastos incidentales, según lo dispuesto en esta sección.

(g) Un viajero que se enferma o se lesiona, mientras está fuera de su sede oficial, y por lo tanto no puede realizar las actividades oficiales de la agencia, puede continuar recibiendo pagos de subsistencia según lo dispuesto en la subsección (6) durante este período de enfermedad o lesión, hasta el tiempo que él o ella pueda realizar los asuntos oficiales de la agencia o regrese a su sede oficial, lo que ocurra primero. Tal subsistencia puede pagarse cuando la apruebe el jefe de la agencia o su designado.

(h) El Cirujano General del Estado o un designado pueden autorizar los gastos de viaje relacionados con la prestación de servicios médicos para y en nombre de clientes del Departamento de Salud. El Departamento de Salud puede establecer tarifas más bajas que la tarifa proporcionada en esta sección para estos gastos de viaje.

(4) SEDE OFICIAL. La sede oficial de un oficial o empleado asignado a una oficina será la ciudad o pueblo en el que se encuentra la oficina, excepto que:

(a) La sede oficial de una persona ubicada en el campo de oficio será la ciudad o pueblo más cercano al área donde se realiza la mayoría del trabajo de la persona, o cualquier otra ciudad, pueblo o área que designe el jefe de la agencia, con la condición de que en todos los casos dicha designación debe ser en el mejor interés de la agencia y no para la conveniencia de la persona.

(b) Cuando un empleado estatal esté estacionado en cualquier ciudad o pueblo por un período de más de 30 días continuos, se considerará que dicha ciudad o pueblo es la sede oficial del empleado, y no se le permitirá per diem ni pagos de subsistencia, según lo dispuesto en esta sección, después de que haya transcurrido dicho período de 30 días laborables continuos, a menos que este período de tiempo se extienda por la aprobación expresa del jefe de la agencia o su designado.

(c) Un viajero puede dejar su puesto asignado para regresar a su casa durante la noche, durante un fin de semana o durante un día festivo, pero cualquier tiempo perdido de los deberes regulares se tomará como vacaciones anuales y se autorizará de la manera habitual. No se reembolsará al viajero los gastos de viaje que excedan la tarifa establecida por per diem permitido si hubiera permanecido en su puesto asignado. Sin embargo, cuando un viajero ha sido temporalmente asignado fuera de su sede oficial por un período aprobado que se extiende más allá de los 30 días, tendrá derecho al reembolso de los gastos de viaje, a la tasa establecida por un viaje de ida y vuelta a su hogar, por cada período de 30 días durante cual haga dicho viaje, además de los pagos y las prestaciones que de otro modo se proporcionarían.

(5) CÁLCULO DEL TIEMPO DE VIAJE PARA EL REEMBOLSO. Para fines de reembolso y métodos para calcular los días fraccionarios de viaje, se prescriben los siguientes principios:

(a) El día de viaje para viajes Clase A será un día calendario (medianoche a medianoche). El día de viaje para viajes de Clase B comenzará al mismo tiempo que el período de viaje. Para los viajes de Clase A y Clase B, se le reembolsará al viajero un cuarto de la tarifa autorizada de per diem por cada trimestre, o fracción del mismo, del día de viaje incluido dentro del período de viaje. Los viajes de Clase A y Clase B incluirán cualquier asignación en asuntos oficiales fuera del horario regular de oficina y fuera de los lugares de empleo regulares, cuando se considere razonable y necesario pasar la noche y para lo cual se aprueben los gastos de viaje.

(b) No se reembolsará a un viajero una base diaria para el viaje de Clase C, pero recibirá pagos de subsistencia según lo dispuesto en esta sección, cuya prestación para las comidas se basará en el siguiente horario:

1. Desayuno: cuando el viaje comienza antes de las 6 a.m. y se extiende más allá de las 8 a.m.

2. Almuerzo: cuando el viaje comienza antes de las 12 del mediodía y se extiende más allá de las 2 p.m.

3. Cena: cuando el viaje comienza antes de las 6 p.m. y se extiende más allá de las 8 p.m., o cuando el viaje ocurre durante las horas nocturnas debido a una asignación especial.

No se hará ninguna concesión para las comidas cuando el viaje está confinado a la ciudad o pueblo de la sede oficial o en las inmediaciones; excepto asignaciones de negocios oficiales fuera del lugar de trabajo habitual del viajero, si se aprueban los gastos de viaje. El Director Financiero deberá establecer un cronograma para procesar los pagos de subsistencia de viaje Clase C, al menos mensualmente.

(6) ÍNDICES DE PER DIEM Y PRESTACIONES DE SUBSISTENCIA. Para fines de las tasas de reembolso y los métodos de cálculo, los per diem y los pagos de subsistencia, se proporcionan de la siguiente manera:

(a) Se permitirán pagos de subsistencia de todos los viajeros, cuando viajen a una convención o conferencia o cuando viajen dentro o fuera del estado, con el fin de llevar a cabo negocios estatales de buena fe, cual convención, conferencia o empresa cumple un propósito público directo y legal con relación a la agencia pública atendida por la persona que asiste a dicha reunión o que realiza dicho negocio, cualquiera de los siguientes para cada día de tal viaje a opción del viajero:

1. Ochenta dólares per diem; o

2. Si los gastos reales superan los $80, las cantidades permitidas en el párrafo (b) para la subsistencia, más los gastos reales para el alojamiento a una tasa de ocupación única, se justificarán con las facturas pagas correspondientes.

Cuando el alojamiento o las comidas se brindan en una institución del estado, el viajero deberá recibir un reembolso solo por los gastos reales de dicho alojamiento o comidas, que no exceda el máximo estipulado en esta subsección.

 

(b) A todos los viajeros se les permitirán los siguientes montos de subsistencia mientras viajan en Clase C por asuntos oficiales, según lo dispuesto en el párrafo (5) (b):

1.  Desayuno .......... $6

2.  Almuerzo .......... $11

3.  Cena .......... $19

(c) A nadie, ya sea que viaje sea fuera del estado o dentro del estado, se le reembolsará cualquier comida o alojamiento incluido en una tarifa de registración a la convención o conferencia pagada por el estado.

(7) TRANSPORTE.-

(a) Todos los viajes deben realizarse por una ruta generalmente recorrida. En caso de que una persona viaje por una ruta indirecta para su propia conveniencia, los costos adicionales correrán por cuenta del viajero; y el reembolso de los gastos se basará únicamente en los costos que se hubieran incurrido en una ruta que habitualmente se viaja. El jefe de la agencia o su designado designará el método de viaje más económico para cada viaje, teniendo en cuenta las siguientes condiciones:

1. La naturaleza del negocio.

2. El medio de transporte más eficiente y económico (teniendo en cuenta el tiempo del viajero, el impacto en la productividad del viajero, el costo de transporte y per diem o el pago de subsistencia requerido). Cuando es más eficiente y económico para el viajero o el jefe de agencia, el servicio de avión ofrecido por cualquier aerolínea, ya sea con contrato estatal o no, se puede usar cuando el costo está dentro de un límite aprobado determinado por el jefe de la agencia o su designado.

3. La cantidad de personas que viajan y la cantidad de equipo o material que se transportará.

(b) El Departamento de Servicios Financieros puede proporcionar cualquier forma que considere necesaria para cubrir solicitudes de viaje para viajar en asuntos oficiales y cuando el estado lo pague.

(c) El transporte realizado por un transportista común cuando se viaja por asuntos oficiales y pagado personalmente por el viajero, se justificará mediante un recibo al respecto. El impuesto federal no será reembolsable al viajero, a menos que el estado y otras agencias públicas también estén obligados por ley federal a pagar dicho impuesto. En el caso de transporte que no sea el de clase más económica aprobado por el jefe de la agencia es provisto por un transportista común en un cheque de vuelo o tarjeta de crédito, los cargos que excedan la clase más económica serán reembolsados por el viajero a la agencia encargada del transporte provisto de esta manera.

(d) 1. El uso de vehículos de propiedad privada para viajes oficiales, en lugar de vehículos de propiedad pública o transportistas comunes, pueden ser autorizados por el jefe de la agencia o su designado. Cuando el viaje sea en vehículo de propiedad privada:

a. Un viajero tendrá derecho a un subsidio por millaje a razón de 44.5 centavos por milla; o

b. Un viajero tendrá derecho a la tarifa del transportista común para tal viaje, si el jefe de la agencia lo determina como más económico.

2. No se permitirá el reembolso de los gastos relacionados con la operación, mantenimiento y propiedad de un vehículo cuando se utilicen vehículos de propiedad privada en negocios públicos y se realice un reembolso de conformidad con este párrafo, excepto lo dispuesto en la subsección (8).

3. Todo millaje se mostrará desde el punto de origen hasta el punto de destino y, cuando sea posible, se computará sobre la base del mapa existente del Departamento de Transporte. Se permite el millaje de vecindad necesario para la realización de negocios oficiales, pero debe mostrarse como un artículo separado en el comprobante de gastos.

(e) El transporte por vehículos alquilados cuando se viaja por negocios oficiales, puede ser autorizado por el jefe de la agencia cuando sea necesario o cuando sea en beneficio de la agencia, siempre que el costo de dicho transporte no exceda el costo del transporte en vehículos privados de conformidad al párrafo (d).

(f) El jefe de la agencia o su designado puede otorgar prestaciones mensuales en montos fijos para el uso de automóviles de propiedad privada en negocios oficiales en lugar de la tasa de millaje proporcionada en el párrafo (d). Las prestaciones concedidas de conformidad con este párrafo serán razonables, teniendo en cuenta el uso habitual del automóvil, las rutas habitualmente transitadas y si alguno de los gastos relacionados con la operación, el mantenimiento y la propiedad del automóvil se pagan con fondos de la agencia u otros fondos públicos. Tal prestación puede ser cambiada en cualquier momento, y se hará sobre la base de una declaración firmada del viajero, presentada antes de que se conceda o cambie la prestación, y al menos anualmente a partir de entonces. La declaración deberá mostrar los lugares y distancias para un viaje promedio mensual típico en un negocio oficial, y la cantidad que se permitiría por debajo de la tarifa aprobada por milla para el viaje que se muestra en la declaración, si el pago se realizó de conformidad con el párrafo (d) .

(g) No se puede celebrar ningún contrato entre un funcionario público o empleado, o cualquier otra persona, y una agencia pública, en la cual se usa una prestación de depreciación para calcular el monto adeudado por la agencia a la persona por el uso de un vehículo privado en negocios oficiales; siempre que dicho contrato existente no se vea perjudicado.

 

(h) A ningún viajero se le permitirán ni el millaje ni los gastos de transporte cuando sea transportado gratuitamente por otra persona o cuando sea transportado por otro viajero que tenga derecho a millas o gastos de transporte. Sin embargo, a un viajero en una aeronave privada se le reembolsará el monto real cobrado y pagado por la tarifa de dicho transporte hasta el costo de un boleto aéreo comercial para el mismo vuelo, incluso si el propietario o piloto de dicha aeronave también tiene derecho a gastos de transporte para el mismo vuelo bajo esta subsección.

(8) OTROS GASTOS.-

(a) Se pueden reembolsar los siguientes gastos de viaje incidentales del viajero:

1. Tarifa del taxi.

2. Tarifas de “ferry”; y peajes de puentes, carreteras y túneles.

3. Tarifas de almacenamiento o estacionamiento.

4. Gastos de comunicación.

5. Cuota de registro de la Convención mientras se asiste a una convención o conferencia que servirá para un propósito público directo con relación a la agencia pública servida por la persona que asiste a dichas reuniones. Se puede reembolsar a un viajero las tarifas actuales y necesarias para asistir a eventos que no están incluidos en una tarifa de registro básica que mejora directamente el propósito público de la participación de la agencia en la conferencia. Tales gastos pueden incluir, pero no se limitan a, banquetes y otras funciones de comida. Será responsabilidad del viajero justificar que los cargos fueron apropiados y necesarios. Sin embargo, cualquier comida o alojamiento incluido en la tarifa de registro se deducirá de acuerdo con las prestaciones provistas en la subsección (6).

(b) Otros gastos que no estén específicamente autorizados por esta sección pueden ser aprobados por el Departamento de Servicios Financieros de conformidad con las reglas que adopte. Los gastos aprobados conforme a este párrafo serán informados anualmente por el Departamento de Servicios Financieros al Auditor General.

(9) REGLAS.-

(a) El Departamento de Servicios Financieros adoptará tales reglas, que incluyen, pero no limitadas a, los criterios generales que utilizará una agencia estatal para predeterminar la justificación de la asistencia de funcionarios y empleados estatales y personas autorizadas en convenciones y conferencias, y prescribirá tales formas como sean necesarias para efectuar los propósitos de esta sección. El departamento también puede adoptar reglas que prescriban la correcta disposición y uso de los artículos promocionales y descuentos ofrecidos por los operadores comunes y otras entidades en relación con los viajes a expensas del público; sin embargo, antes de adoptar tales reglas, el departamento consultará con los comités de apropiaciones de la Legislatura.

(b) Cada agencia estatal deberá adoptar tales reglas específicas adicionales y criterios específicos para predeterminar la justificación de la asistencia de funcionarios y empleados estatales y personas autorizadas en convenciones y conferencias, que no entren en conflicto con las reglas del Departamento de Servicios Financieros o con los criterios generales que utilizará una agencia estatal para predeterminar la justificación de la asistencia de funcionarios y empleados estatales y personas autorizadas en las convenciones, según sea necesario para llevar a cabo los propósitos de esta sección.

(10) RECLAMOS FRAUDULENTOS.-No se requerirá que los reclamos presentados de conformidad con esta sección presten juramento ante un notario público u otro funcionario autorizado para administrar juramentos, pero cualquier reclamo autorizado o requerido bajo cualquier disposición de esta sección contendrá una declaración de que el viajero en realidad incurrió en los gastos como gastos de viaje necesarios en el desempeño de los deberes oficiales y se verificará mediante una declaración escrita de que es verdadero y correcto en cuanto a cada asunto importante; y cualquier persona que deliberadamente haga y suscriba cualquier reclamo que no considere verdadero y correcto en relación con cualquier asunto importante, o que voluntariamente ayude o asista, o procure, asesore o aconseje la preparación o presentación bajo las disposiciones de esta sección de un reclamo que es fraudulenta o es falsa en cuanto a cualquier asunto importante, ya sea que dicha falsedad o fraude sea con el conocimiento o consentimiento de la persona autorizada o requerida para presentar dicho reclamo, es culpable de un delito menor de segundo grado, punible según lo dispuesto en s. 775.082 o s. 775.083. Quien reciba un subsidio o reembolso por medio de un reclamo falso será civilmente responsable por el monto del pago en exceso por el reembolso del fondo público del cual se pagó el reclamo.

(11) AUTORIZACIÓN DE VIAJE Y FORMULARIOS DE VALES.-

(a) Formularios de autorización.- El Departamento de Servicios Financieros deberá proporcionar un formulario de solicitud de autorización de viaje uniforme que deberán usar todos los funcionarios, empleados y personas autorizadas del estado cuando soliciten la aprobación para realizar un viaje a una convención o conferencia. El formulario incluirá, entre otros, la disposición del nombre de cada viajero, el propósito del viaje, el período de viaje, el costo estimado para el estado y una declaración de los beneficios acumulados para el estado en virtud de dicho viaje. Una copia del programa o agenda de la convención o conferencia, detallando las tarifas de registro y cualquier comida o alojamiento incluidos en la tarifa de registro, se adjuntará y archivará con la copia del formulario de solicitud de autorización de viaje en el archivo de la agencia. El viajero y el supervisor del viajero deberán firmar el formulario que establezca que el viaje se realizará en relación con los asuntos oficiales del estado. El jefe de la agencia o su representante designado no autorizarán ni aprobarán dicha solicitud en ausencia de las firmas apropiadas. Se adjuntará una copia del formulario de autorización de viaje y se convertirá en parte del respaldo de la copia del vale de viaje de la agencia.

(b) Formularios de vales.-

1. El Departamento de Servicios Financieros deberá proporcionar un formulario de vales de viaje uniforme que será utilizado por todos los funcionarios del estado, empleados y personas autorizadas al presentar las declaraciones de gastos de viaje para su aprobación y pago. El Director Financiero no aprobará ninguna declaración de gastos de viaje a menos que se haga en el formulario prescrito y proporcionado por el departamento. El formulario de vales de viaje deberá prever, entre otras cosas, el propósito del viaje oficial y una certificación o afirmación, que deberá firmar el viajero, indicando la veracidad y exactitud del reclamo en cada asunto importante, que los gastos de viaje fueron en realidad incurridos por el viajero según sea necesario en el desempeño de los deberes oficiales, que el per diem reclamado ha sido reducido apropiadamente por cualquier comida o alojamiento incluido en la convención o tarifas de inscripción a la conferencia, reclamadas por el viajero, y que el vale cumpla en todos los aspectos con los requisitos de esta sección. La copia original del formulario de solicitud de autorización de viaje uniforme firmado se adjuntará al vale de viaje uniforme en el archivo de la agencia respectiva.

2. Las declaraciones de gastos de viaje relacionados con la prestación de servicios médicos para y en nombre de los clientes del Departamento de Salud se realizarán en formularios aprobados por el Departamento de Servicios Financieros.

(12) AVANCES. A pesar de cualquiera de las restricciones y limitaciones anteriores, el jefe de la agencia o la persona designada por él puede realizar o autorizar la realización de anticipos para cubrir los costos de viaje anticipados para los viajeros. Dichos adelantos pueden incluir los costos de subsistencia y viaje de cualquier persona transportada bajo el cuidado o la custodia del viajero en el desempeño de sus funciones.

(13) PAGO DIRECTO DE GASTOS POR AGENCIA.-Siempre que una agencia exija que un empleado incurra en un viaje Clase A o Clase B por aviso de emergencia al viajero, dicho viajero puede solicitar a la agencia que pague sus gastos de comidas y alojamiento directamente al vendedor, y la agencia puede pagar al vendedor los gastos actuales de comidas y alojamiento durante el período de viaje, limitado a un monto que no exceda el autorizado de conformidad con esta sección. En situaciones de emergencia, el jefe de la agencia o su designado puede autorizar un aumento en el monto pagado por una comida específica, siempre que el costo total diario de las comidas no supere la cantidad total autorizada para las comidas de cada día. El jefe de la agencia o su designado también pueden otorgar aprobación previa para que una agencia estatal realice pagos directos de gastos de viaje en otras situaciones que generen ahorros de costos para el estado, y dichos ahorros se documentarán en el comprobante enviado al Director Financiero para el pago directo de los gastos de viaje. Las disposiciones de esta subsección no se considerarán aplicables a ningún legislador ni a ningún empleado de la Legislatura.

(14) APLICABILIDAD A CONDADOS, OFICIALES DEL CONDADO, JUNTAS ESCOLARES DE DISTRITO, DISTRITOS ESPECIALES Y ORGANIZACIONES DE PLANIFICACIÓN METROPOLITANA.-

(a) Las siguientes entidades pueden establecer tarifas que varían de la tarifa diaria provista en el párrafo (6) (a), las tasas de pagos de subsistencia provistas en el párrafo (6) (b), o la tasa de millaje proporcionada en el párrafo (7) ( d), si esas tasas no son inferiores a las tasas establecidas por ley, establecidas para el año fiscal 2005-2006:

1. El cuerpo gobernante de un condado mediante la promulgación de una ordenanza o resolución;

2. Un oficial constitucional del condado, de conformidad con el s. 1 (d), Art. VIII de la Constitución del Estado, mediante el establecimiento de una política escrita;

3. El cuerpo gobernante de una junta escolar del distrito mediante la adopción de reglas;

4. El cuerpo gobernante de un distrito especial, como se define en s. 189.012, excepto aquellos distritos especiales que están sujetos a s. 166.021 (9), mediante la promulgación de una resolución; o

5. Cualquier organización de planificación metropolitana creada de conformidad con s. 339.175 o cualquier otra entidad legal o administrativa separada creada de conformidad con s. 339.175 de los cuales es miembro una organización de planificación metropolitana, mediante la promulgación de una resolución.

(b) Las tarifas establecidas de conformidad con el párrafo (a) deben aplicarse de manera uniforme a todos los viajes del condado, el funcionario constitucional del condado y la entidad regida por ese funcionario, junta escolar del distrito, distrito especial u organización de planificación metropolitana.

(c) Salvo que se disponga lo contrario en esta subsección, los condados, funcionarios constitucionales del condado y entidades regidas por esos funcionarios, juntas escolares del distrito, distritos especiales y organizaciones de planificación metropolitana, que no sean las sujetas a s. 166.021 (9), permanecen sujetos a los requisitos de esta sección.

(15) VIAJES DE CLASE C.-Los fondos apropiados del Tesoro Estatal no se pueden usar para pagar per diem o pagos de subsistencia relacionadas con viajes de Clase C.

 

Sección 8. Pregunta Número Cuatro de la Papeleta. La forma de la papeleta para la enmienda de la Carta provista en la Sección 7 de esta Ordenanza será la siguiente:

Se propone una enmienda para enmendar la Carta de la Ciudad de Sanford para exigir que la compensación y los gastos pagados a los funcionarios electos de la Ciudad estén vinculados a una fórmula y a las tasas establecidas en los estatutos del Estado.

Se convoca a una elección de referéndum que se celebrará el 28 de agosto de 2018 para presentar a los electores de la Ciudad de Sanford la pregunta contenida en esta Ordenanza. Se solicita al Supervisor de Elecciones del Condado de Seminole que coordine todos los asuntos relacionados con dicha elección de referéndum con el Secretario Municipal, la División de Elecciones del Departamento de Estado de la Florida, y el Administrador Municipal, el Secretario Municipal y el Fiscal Municipal.

 

Sección 10. Agradecimiento Por el Trabajo del Comité de Revisión de la Carta.

 

La Comisión Municipal expresa su agradecimiento por la diligencia, el servicio público y el trabajo de alta calidad del Comité de Revisión de la Carta.

 

Sección 11. Deberes del  Secretario  Municipal.

 

Se le ordena al Secretario Municipal asegurar que se cumplan los requisitos de publicidad y aviso de la Sección 100.342, Estatutos de la Florida, y coordinar todas las actividades necesarias para llevar a cabo la elección del referéndum convocada en esta Ordenanza con el Supervisor de Elecciones del Condado de Seminole.

 

Sección 12. Carta Revisada de la Ciudad de Sanford.

 

Si las enmiendas propuestas a la Carta de la Ciudad de Sanford son aprobadas por el electorado en la elección de referéndum solicitada en esta Ordenanza, es la intención del Concejo Municipal, y por la presente se ordena, que las disposiciones aprobadas de esta ordenanza se convertirán y se harán parte de la Carta de la Ciudad de Sanford. El codificador del Código de la Ciudad tiene poder y autoridad amplios y liberales para codificar la Carta de la Ciudad de Sanford en términos de realizar los cambios armonizadores, técnicos o editoriales apropiados y notas que no afecten las disposiciones sustantivas de los mismos.

 

Sección 13. Divisibilidad.

 

Si cualquier sección, párrafo, oración, cláusula, frase u otra parte de esta Ordenanza es declarada inválida por un tribunal de jurisdicción competente, dicha decisión no afectará la validez de esta Ordenanza como un todo o una parte de la misma, salvo la parte declarada inválida.

 

Sección 14. Fecha de Vigencia.

 

Las disposiciones de esta Ordenanza entrarán en vigor inmediatamente después de su promulgación. Las enmiendas a la Carta de la Ciudad de Sanford propuestas para su aprobación en esta Ordenanza, entrarán en vigencia solo después de la aprobación en una elección de referéndum de los electores de la Ciudad de Sanford, de acuerdo con las disposiciones de la Sección 166.031 de los Estatutos de la Florida.
