NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN by the Mayor and City Commission of the City of Lake Mary, Florida, that said Commission will be holding a Public Hearing on Thursday, April 19, 2018 at 7:00pm (or as soon as possible thereafter) to consider a request for Conditional Uses and a Site Plan with a Landscape Variance and Developer’s Agreement for the Orlando Health Freestanding Emergency Department and Medical Pavilion, to be located at the northwest corner of Rinehart Road and Manderley Run/Siemens Entrance. The subject property consists of Seminole County Parcel ID numbers: 07-20-30-5MK-0000-002D, 07-20-30-5MK-0000-0020, and 07-20-30-5MK-0000-002C. A Location Map and Project Area Map is shown below.

The Conditional Use requests generally consist of: A Hospital Use, Parking Garage Use, Hospital Height, Emergency Room Height, Medical Office Building Height, and Parking Garage Height. 

The Site Plan consists of the construction of: A +/-44,000 sq. ft. Emergency Department, a +/-60,000 sq. ft. Medical Office Building, a Helipad, and associated infrastructure.

This is to give notice that HUD has conducted an evaluation as required by Executive Orders 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection.  The activity is being assisted under the FHA Mortgage Insurance program Section 221(d)(4).  The proposed project is located south and off of U.S. Highway 17-92, east of Rachelle Avenue and west of Willner Circle in Sanford, Seminole County, Florida.  The proposed location is referenced by the address 2205 W. Seminole Blvd. Lake Monroe Apartments, a proposed 280-unit multi-family development, is a 14.42-acre parcel partially located within the 100-year floodplain and containing a forested wetland.  The proposed activity will impact 7.78 acre feet of 100-year floodplain, 1.9acres of jurisdictional wetland, and 0.56 acre of non-jurisdictional (aka, isolated) wetland within the project area. The wetland impacts are associated with fill for construction of an entrance road to the property, a clubhouse with pool amenity and parking, as well as excavation for a storm water pond.  The floodplain impacts are associated with the same fill and excavation as well as additional fill associated with the construction of an apartment building and additional parking.   The jurisdictional wetlands and 100-year floodplain on the development site are located on the northern portion of the proposed development, adjacent to Seminole Boulevard.  Due to this, impacts to the floodplain and wetlands will be necessary to provide primary access to the development site via Seminole Boulevard. Floodplains provide natural stormwater and floodwater storage and flow attenuation, erosion control, and habitat for flora and fauna.  Wetlands provide for surface water storage, natural groundwater recharge and filtration, biochemical recycling, flood attenuation and habitat for flora and fauna.  All of these beneficial functions and values may be adversely affected by the proposed activity.  

Based on existing conditions of the site and required habitat for area endangered species listed for Seminole County, no protected species are expected to occur in or surrounding the floodplain or wetlands areas.  Additionally, wildlife utilization is limited within this wetland and floodplain system due to the location of the systems adjacent to the road and surrounding developments, and the existing wetlands receive runoff from the adjacent Seminole Boulevard and area developments Therefore, impacts from loss of habitat for flora and fauna associated with floodplain and wetlands impacts is determined to be of minimal significance or impact.

HUD has considered the following alternatives actions and and/or techniques as options to avoid or minimize adverse impacts and to restore and preserve natural and beneficial values:

Minimize Impacts or Avoid the 100-Year Floodplain and Wetland. The construction of a bridge over a portion of the floodplain and wetlands was evaluated as an alternate as this would minimize impacts; however, the cost associated with the construction of a bridge is not practicable for the proposed development to remain affordable.  Another alternative would be to provide sole access to the development via Terwilliger Lane, located south of the site, however, the density needed to make this community successful is dependent upon utilizing the entire property, including the land currently within the 100-year floodplain and containing wetlands. Use of alternative materials such as pervious asphalt or concrete were considered to minimize loss of certain beneficial functions, however analyses indicate that the additional costs are disproportionately large in relation to the anticipated benefits.

Do Nothing.   A no action alternative was considered but ultimately rejected due to the need for  additional rental housing both, within the Sanford area of Seminole County, and in proximity to major thoroughfares, public transportation, community facilities and services providers, and recreational amenities.

The analysis and reevaluation of these options indicates that there is no practical alternative.  However, the following mitigation will be implemented to minimize loss of the above beneficial functions and values:

Mitigation for the impacts to wetlands will consist of the purchase of wetland mitigation credits from the mitigation bank available in the drainage basin of the proposed development.  Given the existing conditions noted above, this will provide greater long-term ecological value than retaining the wetlands on-site.

For mitigation of floodplain impacts, the City of Sanford Code requires that total compensation for any impacts to the floodplain be provided on-site.  Therefore, an additional volume for stormwater retention of 7.91 acre-feet is included in the proposed construction plans.  The project is also in compliance with state and local floodplain and wetland procedures.

HUD has reevaluated the alternatives to building in the floodplain and wetlands and has determined that it has no practicable alternative.  Environmental files that document compliance with steps 3 through 6 of Executive Orders 11988 and 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.  

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains or wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and wetlands, it must inform those who may be put at greater or continued risk.
